was within his rights to appoint former Alabama Attorney
General William Pryor to its bench while the U.S. Senate
was on a five-day recess.
"In an 8-2 vote, the 11th Circuit Court of Appeals rejected
Democratic Sen. Edward Kennedy's argument that the appoint-
ment during the President's Day break in February violated
the Senate's right to confirm or reject federal judicial
nominees.

"'We are not persuaded that the president acted beyond his
authority in this case: both the words of the Constitution
and the history of the nation support the president's author-
ity,' the court said.

filibusters of Pryor and other judicial nominees as

The Dems in the Senate have misused the filibuster to
prevent confirmation votes -- because they know they
would lose such votes on nominees like Pryor.
The Dems are trying to force ALL nominees to promise
under oath to follow the Dems' aganda on abortion and
other social topics before they'll allow a vote.
