Are there any legitimate people here? |
I just wasted a couple days wrestling with a bunch of two-bit sophist trolls
who inhabit this newsgroup. Now that I have most of them them tucked away in
my killfile, are there any adults who are interested in having a serious,
adult discussion on some of the issues surrounding abortion?

I bought a Venus Fly Trap today. I was going to name it
‘Republican’, but the fly trap is beneficial to the
environment. I’ll save that name - someday I might find
a plant that eats poor people and minorities.

have to agree, but in many jurisdictions the law takes the position that
there is an interest in the life of the fetus that increases and becomes
more compelling as the fetus approaches viability. It's not a cut and dried
thing. That whole concept of the interests of the fetus becoming more
"compelling" raises questions in me that I can't easily answer.

3. State criminal abortion laws, like those involved here, that except from
criminality only a life-saving procedure on the mother's behalf without
regard to the stage of her pregnancy and other interests involved violate
the Due Process Clause of the Fourteenth Amendment, which protects against
state action the right to privacy, including a woman's qualified right to
terminate her pregnancy. Though the State cannot override that right, it has
legitimate interests in protecting both the pregnant woman's health and the
potentiality of human life, each of which interests grows and reaches a
"compelling" point at various stages of the woman's approach to term. Pp.
147-164.
(a) For the stage prior to approximately the end of the first trimester, the
abortion decision and its effectuation must be left to the medical judgment
of the pregnant woman's attending physician. Pp. 163, 164.
(b) For the stage subsequent to approximately the end of the first
trimester, the State, in promoting its interest in the health of the mother,
may, if it chooses, regulate the abortion procedure in ways that are
reasonably related to maternal health. Pp. 163, 164.
(c) For the stage subsequent to viability the State, in promoting its
interest in the potentiality of human life, may, if it chooses, regulate,
and even proscribe, abortion except where necessary, in appropriate medical
judgment, for the preservation of the life or health of the mother. Pp.
163-164; 164-165.
I am not knowledgeable on exactly which states may have implemented second
or third trimester regulations according to these guidelines. France and
Australia have set limitations.
It's not a cut and dried
thing. That whole concept of the interests of the fetus becoming more
"compelling" raises questions in me that I can't easily answer.

I argued that the point had no substantive meaning and you never addressed
that. If a fetus essentially has a right to life identical to a person
(protected by murder statute) then what more significant status (right) is
possible for a fetus? It becomes assured that they only 'bide their time'
for whatever number of weeks and the rest will come, whatever that may be.
