Object: Duke Rape Accuser: Victim or Victimizer?
Accuser: one who brings an accusation; one who charges an offense judicially
or by a public process.
Victim: one who is injured, destroyed or sacrificed under any of various
conditions; one who is subjected to oppression, hardship or mistreatment;
one who is tricked or duped.
Victimizer: one who makes a victim of another; one who subjects another to
deception or fraud.
An "exotic dancer," reportedly a divorced mother of two who was hired to
perform as a stripper at an off-campus Duke lacrosse team party, claims to
have been raped by three white members of the team. The dancer is black. The
specifics of her charge spared the sole black member of the team from giving
a DNA sample and subjected more than forty white teams of the team to that
indignity.
To date, DNA testing has not tied any of the black player's white teammates
to the alleged rape.
Unfortunately, the mainstream media has been treating the dancer as a
victim.
But, it is far from clear that she IS a victim.
She IS an accuser.
She MAY be a victimizer. And the players whom she has accused may be
victims. Victims of a false accusation AND their own foolishness in
attending a party at which such a dancer provides "entertainment."
BUT, just as being an exotic dancer is not a waiver of the dancer's right
not to be raped, a player does not waive his right not to be falsely accused
by indulging in such "entertainment."
Regardless of the sad state of town-gown relations between Durham, North
Carolina and Duke University, both the dancer and the lacrosse players are
entitled to be treated fairly.
Unfortunately, while the two players indicted have been publicly identified,
their accuser has not been.
Under the circumstances, the search for the truth requires that the
backgrounds of all concerned be carefully examined and it needs to be
remembered that an accusation is not a determination of guilt.
Is the dancer another Tawana Brawley? That is, a hoaxer.
Tawana Brawley was a 15-year-old black female who attracted national
attention after claiming that she was raped by white men on November 28,
1987 in Wappingers Falls, New York. Ms. Brawley indicated that she had been
raped repeatedly in a wooded area by three white men, at least one of them a
police officer. A rape kit was administered, and police tried to build a
case.
Despite the lack of any evidence, the alleged incident soon became a media
sensation, championed by Reverend Al Sharpton, the Democrat presidential
aspirant, and two black attorneys, Alton H. Maddox and C. Vernon Mason.
Public response to Ms. Brawley's story was at first mostly sympathetic. It
was headline news across the nation. Public rallies were held denouncing the
incident and racial tensions increased.
Sharpton, Maddox and Mason charged that the entire case was a coverup going
all the way up to the state government. They named New York prosecutor
Steven Pagones specifically, calling him a racist and a rapist, among other
accusations.
By the time of grand jury hearings, six men had been accused of rape.
After seven months of examining police and medical records, the jury
determined there was not enough evidence to charge anyone with a crime.
Following the grand jury decision, Ms.Brawley and her family moved quickly
to Virginia, taking with them a "defense fund" of $300,000, which had been
contributed by well-wishers.
Sharpton, Maddox, and Mason were later successfully sued for statements made
in connection with the case, and ordered to pay $345,000 in damages.
Maddox was later disbarred after being accused of bilking and abandoning
clients in an unrelated series of incidents.
What is needed in the Duke lacrosse team alleged rape case and every other
case in which an accusation of criminal conduct is made is impartial and
intense investigation, not incitation.
If there was rape, let any rapist be convicted.
If the dancer is trying to perpetrate a hoax, let her be convicted.
Until the facts are established, let's call the dancer the accuser, NOT the
victim.
