GEORGETOWN , Del.- A Sussex County jury on Friday, Oct. 21 found a Greenwood
woman guilty of murdering her newborn baby.
After nearly a full day of deliberations, the jury found Julie L. Bailey,
27, guilty of first-degree murder by abuse and neglect in the death of her
newborn child. Bailey now faces 15 years to life in prison. Delaware
Superior Court Judge Richard F. Stokes set her sentencing date for Dec. 9.
WBOC's Elizabeth Harrington, who was present during the jury's verdict,
reports that when the foreman read aloud the jury's verdict, Bailey sat
stone-faced and did not express "a single emotion, not one word, nothing."
After the verdict was read, Stokes revoked Bailey's bond and she was
transferred to Baylor Women's Correctional Institution, the First State's
only prison for women.
The jury's decision came just a day after Judge Stokes denied a defense
request to dismiss murder charges against Bailey, who claimed she had an
affair, got pregnant, delivered the baby herself in a friend's home and then
on Jan. 28, 2003, left the baby on the doorstep of the Georgetown home of
her lover, David Wingate. But the problem is that the baby never was found.
About three and a half months later, the police learned about what happened
and spent several months looking for the missing baby, with no success.
After hearing preliminary evidence in the case, a grand jury on Sept. 13,
2004 indicted Bailey for first-degree murder by abuse or neglect.
During her nearly two-week trial in Georgetown, prosecutors played back
Bailey's videotaped testimony to Delaware State Police investigators.
In her testimony, Bailey, a waitress and nursing assistant who also was
majoring in nursing at Delaware Tech at the time, admitted to delivering the
baby herself. What Bailey described to investigators during her videotaped
testimony left courtroom observers like Dayna Nauss shocked.
"The detective said, 'Did you know whether it was a boy or a girl?' and she
said, 'No, because I didn't care,'" Nauss said. "At that point the jury
reacted strongly to that statement and even I did, because I'm a mother."
In her testimony, Bailey told the police that she cut the baby's umbilical
cord with a pair of hair scissors. She said that she cleaned the baby off
with water from the toilet because the pipes of the house were frozen on
that frigid January day. Bailey said that she then wrapped the baby up in a
bathroom floor mat and then laid the baby on the backseat of her car.
After driving to her lover's home, Bailey claimed that she dropped off the
baby on his lover's doorstep. She said that after she knocked on the window,
someone peeked out and she ran to her car and drove away. Bailey told
investigators that she was sure someone was coming to the door to bring the
baby inside. But the baby was never found.
Prosecutor Melanie Withers told the court that Bailey's alibi holds no
weight. They pointed out that Bailey's lover no longer lived in the
Georgetown home when she claimed to have taken the baby there.
Withers told the court that she believed Bailey killed the baby and disposed
of the body to hide her affair from her husband- who had a vasectomy and
could not have fathered the child. The couple had two children prior to her
husband's vasectomy.
Withers told Bailey, who took the stand on Thursday, "The best thing for you
that night was to have that baby disappear off of the face of the earth."
Bailey, who according to Nauss, replied with very little emotion, told
Withers, "No, I did not kill my baby."
Withers also said that even if Bailey's claim that she dropped the baby off
on the doorstep was true, the child likely died of exposure to cold as the
high temperature on that day was 32 degrees fahrenheit and the low was a
bone chilling 6 degrees.
The police were ultimately tipped off on the case due to Bailey's friend,
Joy Clark, who was with her the night the baby was born. The police said
Clark told a friend that Bailey had delivered a baby. The friend ended up
telling her father, who in turn contacted the police out of concern for the
child's welfare.
David Wingate, Bailey's former lover and father of the unborn baby said that
he was "very relieved" following Friday's verdict. Wingate did not even have
a clue that Bailey was pregnant (and married) until the police contacted him
during the course of their investigation into the baby's disappearance. He
said now that she has been found guilty, he hopes that Bailey spends the
rest of her life in prison.
Wingate said he is now going to get a birth certificate for the baby and
give it a name.
