Nice try, but perhaps you've not thought the issue out far enough?
Assume, for the nonce, that we actually *want* to go through with
this policy and ban most abortions save those for medical necessity
(the only exceptions I would allow are for women who would
demonstrably die without the procedure, which would be identical
to the first-trimester procedure done today, if they're lucky;
see, however, #6 below).
Now let's spin some scenarios.
[1] Anne is at a local bar. Alcohol is known to cause
Foetal Alcohol Syndrome, and Anne is pretty enough
that any guy would be honored to seduce her into his
bed, especially if she has had one too many and grabs
his tie to seduce him into *her* bed. Should Anne be
prohibited from drinking? When? Bear in mind alcohol
remains in the body for some time after imbibing;
the effects are well-known to law enforcement.
[2] Betty is pregnant, according to a pregnancy test,
and walks into a bar, smoke shop, or convenience
store, perhaps intending to buy a drink or cigarettes.
Should she be required to do either of the following?
[a] sign an indemnification form forbidding her from suing
the bar, should the baby have any syndrome linked to the
consumption of items served thereby.
[b] prohibited by the force of law from consuming anything
that could possibly damage the baby (the bartender would
request proof of non-pregnancy prior to serving any drinks).
[3] Carol is walking down the street, near a notorious abortion clinic
which is operating legally (since abortions for medical necessity
*are* allowed) but is under watch from Doug, who happens to be
walking the beat or tooling around in a prowl car. Should Doug
do any of the following, upon seeing Carol?
[a] Arrest her for walking too near to an abortion clinic without
proper authorization.
[b] Call in backup.
[c] Keep Carol under surveillance, and, if she does walk into the
clinic, arrest her when she comes back out under suspicion
of first-degree murder.
[d] Walk into the clinic after Carol has walked out and demand her
medical records for filing at the local precinct, as well
as taking any necessary samples to verify Carol has not had
a first-trimester procedure.
[e] Require Carol to take a DNA identification test.
[4] Elaine and Frank are happily married, but have discovered that
she can only have the one child (which they are now raising), as
the second child would immediately be attacked by her immune
system, as she has negative Rh factor but Frank has Rh+, and
she has become sensitized. She becomes pregnant again and by
the time the doctors discover this, it is too late to save
the unborn child. Should she abort?
[5] Gina is a healthy young adult woman who wants to have
a baby and has found Mr. Right -- or so she thinks.
However, Mr. Right gets killed in an automobile
collision, and for various reasons government agencies
will not give her TANF. Gina's pregnancy is now 8
weeks along. What should she do? What should law
enforcement do?
[6] Harry is a furtive sort. Oftentimes one can see
him looking strangely at young girls at the mall --
not illegal in itself, but mall security is not happy.
Ingrid, a daughter of one of the locals and of age 14
or so, likes to hang out at the mall with her friends.
Harry sees Ingrid. Harry nabs Ingrid. Harry assaults
Ingrid. The authorities, fortunately, nab Harry.
Ingrid, shaken by her experience, goes to a doctor and
discovers she is now pregnant, and, more importantly,
she is now well-developed enough to continue the
pregnancy until birth -- and in fact would be legally
required to, were she an adult. What should she or
her parents (assuming they're notified) do?
[7] Jan is an unhappy sort. Her mother, Kelly, was divorced
from Dad (Lonnie) at an early age, and more often than
not Jan hears about Dad as "that stupid idiot ex".
However, Lonnie does have visitation rights, and Jan is
now of an age that she's a stunner. Unfortunately, Lonnie
is lonely, and Kelly slightly clueless ... until a
regular checkup discovers Jan is now pregnant, and furthermore
that the most likely father is her dad. What should
Jan, Kelly, or the authorities do? (Assume Jan is of an age
similar to Ingrid, above, and healthy enough to have
the child.)
[8] Marge is a successful businesswoman, which
unfortunately for her leaves few options in her love
life. It turns out, though, that Marge secretly is
contemplating an abortion without anyone knowing at her
employer's, at a supposedly legal clinic. Assume that
Nolan, a paper-shuffler handling official documents
from her doctor, happens to see this (as there's a
24-hour mandatory waiting period). Indicate what
should happen next, assuming there's sufficient time.
[a] Nolan should contact Marge and congratulate her on her
pregnancy, with a subtle hint that to do otherwise
might be unpleasant (blackmail).
[b] Nolan should call the black-and-whites, to arrest Marge.
[c] Nolan should call the black-and-whites, to arrest the
doctor at the clinic, as the paperwork has insufficient
justification for an abortion.
[d] Nolan should call the black-and-whites, to keep Marge
under surveillance and with instructions to prevent
her from re-entering the clinic.
[e] Nolan should contact Marge's employer, and advise him
that she may be contemplating an abortion.
[f] Nolan should file the paperwork, and do nothing.
[9] [a] Odelia is an immigrant from Jerusalem, who
unbeknownst to her is pregnant during traveling.
She has a proper visa to visit a cousin in the
United States, but also doesn't want the baby once
she finds out she's pregnant. The cousin now knows
she's pregnant and also knows the law. Indicate what
should happen next. (Assume her visa allows sufficient
time for a clinic visit.)
[b] Substitute Brazil, a pro-life government, for Israel in the above.
[c-d] Assume that Odelia does know she's pregnant, and
inadvertantly tells US authorities she's going
to have an abortion while visiting her cousin.
[e-f] Assume that Odelia does know she's pregnant, and
inadvertantly tells Israeli/Brazilian authorities
she's going to have an abortion while visiting
her cousin.
[10] Pauline is a doctor, specializing in ob/gyn practice.
She sees a fair number of women, many of whom
are pregnant. The authorities get a tip from an
unknown source ("Q") that she may be performing
illegal abortions, and this source has been credible
in the past. Indicate what should happen next.
