East Chicago — The Rev. Lee C. Gilliam faces new charges stemming from
the Build Indiana Fund scandal.
The pastor of New Second Baptist Missionary Church in East Chicago was
sentenced in November 2003 to four years of community corrections
after pleading guilty to stealing a portion of $445,000 in state
grants earmarked for building a battered women’s shelter in East
Chicago.
This week Marion County prosectors charged him with three felony
counts of failing to file income taxes in 2002, 2003 and 2004.
The evidence was uncovered by a grand jury in the Build Indiana case,
which sought to determine if Gilliam had paid court-ordered
restitution, said Roger Rayl, spokesman for the Marion County
prosecutor.
“We have no evidence that he paid any restitution,” Rayl said.
Gilliam’s legal counsel, Indianapolis attorney Lee Buckley, did not
return a phone call left with his office seeking comment.
In 2003, prosecutors showed Gilliam spent a portion of the grant money
on a trip to Las Vegas, an anniversary party and an extensive
wardrobe.
Three East Chicago buildings also were purchased with the money. At
the time, the Post-Tribune found people paying rent in one of the
buildings. There was no evidence that any money was ever spent to open
a women’s shelter.
Instead, Gilliam admitted he forged documents from contractors to the
State Budget Agency, declaring the project was complete. The state
agency oversaw the grants, which had been parceled out through each
state lawmaker, until the scandal ended the program.
Sen. Sam Smith, D-East Chicago, who secured the grants for Gilliam,
was never charged in connection with the misappropriated funds. He did
plead guilty to misdemeanor charges of failure to remit sales tax in
connection with his funeral home, stemming from evidence uncovered in
the case.
Gilliam will be scheduled for a hearing before Marion Superior Court
to determine if his sentence will be over the latest round of
allegations, including a failure to pay restitution, Rayl said, and
could face jail time.
A hearing is scheduled May 23 in Indianapolis.
Gilliam is free on a $25,000 bond.
