MOREHEAD CITY — A former Morehead City pastor convicted in 2001 of
embezzling church funds is back in custody in Carteret County after
failing to report for probation.
Robert Lee Albritton, 55, is being held in the Carteret County jail
under $500,000 bond for violating the probation he received in
conjunction with suspended sentences for three counts of embezzlement
and one count each of credit card fraud and obtaining property by
false pretenses, said Jim Parker, Judicial District 3B manager for the
N.C. Division of Community Corrections.
The former pastor of St. Stephen’s AME Zion Church was to serve the
probation upon completion of the 14-month active prison sentence that
followed his conviction. He was sentenced on Sept. 12, 2001.
Albritton was released from prison on Nov. 11, 2002.
An appeal of the case put the probation on hold, but after the appeal
was denied on Nov. 10, 2003, Albritton never reported to his probation
officer.
“He failed to make himself available for supervision,” Parker said.
Probation officials were not able to locate Albritton through any of
the known contacts for him.
Albritton, who has reportedly been living in Greensboro, was picked up
for an unrelated reason in Virginia last week and held for authorities
in Carteret County, Parker said.
He was admitted to the Carteret County jail on Feb. 24. During his
first appearance in court, the judge set his bond at $100,000 for each
of the five probation violations.
If found guilty of the violations, Albritton could face additional
jail time for not meeting the conditions of his probation.
Parker said Albritton was subject to the conditions of intensive
probation, including contact with a probation officer five times a
week and not leaving Carteret County without permission.
Albritton was convicted of misusing more than $48,000 in church funds,
including a portion of a $230,000 bequest made to the church for
maintenance of the 100-year-old building and a $57,000 insurance
settlement for hurricane damage to the church.
The Morehead City Police Department and State Bureau of Investigation
conducted an investigation after receiving a complaint from a group of
church trustees seeking an accounting of how funds had been spent.
The investigation showed some money went to personal expenses while
other funds were used for church-related purposes other than intended.
A Carteret County jury heard the case and convicted Albritton of 12
counts of embezzlement, three counts of financial transaction card
fraud and one count of obtaining property by false pretenses.
Albritton took the stand in his own defense during the trial and
denied any wrongdoing. He said his interest was meeting the church
mission as agreed to by the congregation.
He also justified his establishment of a nonprofit community
development corporation. While the prosecution said it was a bogus
corporation that was used to filter church funds, Albritton said it
was to meet a church mission of providing low income housing.
