PORTSMOUTH — A Massachusetts man was sentenced to serve 90 days in
jail for feeling the breasts of teen girls, whom he also pulled under
water, in a Water Country wave pool last summer.
Christopher Andino, who was 19 when the July 24 water park incidents
occurred, appeared in Portsmouth District Court Tuesday for sentencing
on two charges of sexual assault and two charges of simple assault.
Andino was found guilty of the four charges on Feb. 16 by Judge Sawako
Gardner, following a three-hour trial featuring testimony from the
victims.
Before his sentencing, prosecutor Susan Boone told the court that
Andino treated the young girls, "as if they were just another
amusement at Water Country."
"This wasn’t just harmless fun," Boone told the judge. "I can tell you
that several months later, (the victims) are still affected."
Andino’s attorney, Anthony Rozzi, told the judge that his client had
never been in trouble before this incident, that he’s church-going,
has strong family ties and is in the second semester of a study
program toward a criminal justice degree. Andino also works full time,
Rozzi told the court, contributing part of his earnings to his family
household.
Rozzi asked the court for leniency on the basis that his client did
not lie, flee or try to hide.
Gardner imposed fines of $2,000 on each of the simple assault charges,
with both fines suspended providing Andino remains arrest-free for one
year and complies with all court orders.
The judge sentenced Andino to 12 months in a house of corrections for
each of the two sexual assault charges, with all but 45 days suspended
on each and with conditions. Those conditions include no contact with
the victims, no entry into Water Country, attendance in a sex offender
program and proof of completion of that program.
Rozzi told the court he intends to appeal the convictions, and the
judge suspended Andino’s jail time until the case is heard on appeal
in Rockingham County Superior Court.
