A mother of three children who was raped by her employer at her
workplace in 2002 has instituted a damages claim for R734 000 against
him in the Pietermaritzburg High Court.

Her former employer, Howick businessman Jaichand Maharaj, was
convicted on March 14 last year by a regional court in
Pietermaritzburg of having raped the woman on September 12 2002.

According to the court papers, the woman says that between May and
September 2002 Maharaj indecently assaulted her, sexually harassed
her, raped her, maliciously and falsely sought to institute a
prosecution against her, and impaired her dignity and reputation.
In this regard it is alleged that on various occasions he made "crude
and inappropriate comments of a sexual nature" to her in the
workplace; that he spoke in a sexually explicit way offensive to her,
hugged and kissed her against her will, committed indecent acts
described in the papers and told her he wanted an "office wife",
suggesting she fulfil that role.
He was also allegedly derogatory of the woman's race.
His conduct culminated in the rape on September 12 2002 while she was
at her desk.
Afterwards he allegedly told the woman she could resign, but that she
must not tell anyone what had happened.

She has allegedly suffered severe psychological trauma, was too
distraught to stay on her own, has undergone treatment in the form of
an "abortion pill" that was administered to her, has received
counselling from Rape Crisis and requires further counselling but is
unable to receive it because of her financial circumstances.
