twins, is the first person prosecuted under a state fetal protection
law. The prosecution claims that Gerardo Flores beat his girlfriend,
Erica Basoria, in May of 2004 causing her to have a miscarriage.
However, the defense claims that Basoria repeatedly punched herself
with Flores standing on her abdomen. Flores is the first person in
Texas to be tried under the Fetal Protection Law which extends the
protection of the entire criminal code to an unborn child.
