Police Begin Checking Bags on NYC Subways
------
When are people going to figure out that these types of searches conducted
at the airports and now subways are unconstitutional? I suppose as long as
the government is willing to give people that false sense of security the
masses will be more than willing to give up their civil liberties.

¶ It a farce. Why search people you know? It's the unknowns that are a
threat. If I was born in the US and my birth certificate has been filed at
the town office ALL MY LIFE, isn't this information available? My parents
and grandparents birth certificates? The fact that my company bought the
ticket and I'm on offical business? Why not feed it into the fucking airline
computers! Come on now, everybody a suspect? The whole thing is a joke. The
enemy can get through anytime they want to because we can't racial profile
or hurt their feelings?. Security doesn't fool me.§

Much as I hate to disagree with you friend, BUT the TA is private so it
like when you go into an office or court building. If you don't want
your bag checked, don't go into the subway/court/office etc.
YES! it stinks because of a bunch of kooks (I mean that on both sides)
we have to have this nonsense

To clear things up: as a state-chartered corporation, the MTA's
property is indeed considered private in terms of the law. IOW,
they're free to eject you from it under certain conditions, set rules
for using it, etc.
As for public funds, yes there are lots. Most of the capital
construction that happens is funded with state-issued, tax-free bonds.
The city and state, as well as the feds, also chip in money for
various parts of the operating and capital construction portions of
the budget.

I did some reading about the New York Transit Authority but I couldn't find
out if it was private or not, but what I read did seem to imply that the subway
was run by the City.
Private or not, the city government gave the order to do random searches which
is a violation of the fourth amendment.

It's quite reasonable to assume that muslim males with backpacks on,
wearing long coats in warm weather, or wearing bulky shirts should
get a 2nd glance. Profiling works.

And since these funny clothes are actually part of their anatomy, they
can't take them off even if they're trying to sneak into the airport

Except of course the ones who don't. That's why you have
to go by the eye test. Or if you're still not sure, ask
them to dig up something with a shovel, and see which foot
they use. [Yes, I'm still on the Northern Irish thing.]

The searches are illegal and I think anyone who is refused entry into
the subway for refusing to be searched should file a civil rights action.
On the other hand, the police can and should search anyone who gives
them probable cause, like wearing a heavy bulging overcoat in July. This
is quite Constitutional.

marijuana, cigerettes cartons without tax stamps, heroin slabs, will all
be arrested after being searched.
Plenty of overtime for everybody.
The searches are illegal and I think anyone who is refused entry into
the subway for refusing to be searched should file a civil rights action.
On the other hand, the police can and should search anyone who gives
them probable cause, like wearing a heavy bulging overcoat in July. This
is quite Constitutional.
What about a swarthy muslim male with a backpack on?

No, they will not search everyone. That is also part of the problem. I'm
sure that some folks who are not suspected to being terrorists but fit
the
police's biased idea of what a bad guy looks like will get searched in the
hopes of finding something illegal. I hope the ACLU get involved and
helps
to stop the stupidity.

Yeah well, those carrying crack rocks, crack pipes with crack residue,
marijuana, cigerettes cartons without tax stamps, heroin slabs, will all
be arrested after being searched.

What about the tourists on the sightseeing bus with the bulging pockets?
http://www.nydailynews.com/front/story/331264p-283131c.html
from the article: 'had backpacks and their pockets "stuffed"'
It's disgusting! Note the driver's name.
These tourists will return to NY real soon.

If he is also carrying a book entitled, "72 Virgins: Allah, Martyrdom,
and You," I might be suspicious of him.

Answer the question Bill. Would you feel safe on a subway, train, or
bus with a middle-eastern looking man or men wearing backpacks or
carrying large packages without them having been stopped and searched
first?

Damned straight, and it is crazy for the Bushites to continue to insist
that there will be no profiling done.
