A number of those differences allow women to get pregnant. There are
laws on the books that state that an employer MUST allow women
maternity leave after she gives birth. In general, men are not
elegible for maternity leave (there are some reasonable exceptions,
like the woman dies in childbirth, so he now has to take care of the
newborn.) By your reasoning, since men cannot get pregnant, women
should be denied maternity leave. Abortion laws are pretty much in
the same category of laws. The physical differences inherent in the
genders require a law that women can use, but not men. If/when men
can become pregnant, then men will be able to take edvantage of
exactly the same laws.
