Texas mom who stoned sons not guilty
TYLER, Texas (AP) -- A woman who claimed God ordered her to bash in the heads of
her sons was acquitted Saturday of all charges after a jury determined she was
legally insane during the killings.
A jury found that Deanna Laney did not know right from wrong May 9 when she
killed her two older sons, ages 6 and 8, in the front yard and left the
youngest, now 2, maimed in his crib. Laney, 39, was found not guilty by reason
of insanity of charges of capital murder and serious injury to a child.
Laney broke into tears as the verdict was read. Her husband, Keith Laney, sat
emotionless. A few jurors cried and struggled to maintain their composure.
State law allows Laney to be committed to a maximum security state hospital.
Medical evaluations will dictate when she will be released.
In closing arguments earlier Saturday, prosecutors portrayed the killings last
Mother's Day weekend as deceptively planned and coldly executed.
"It was graphic, it was horrific and it was brutal," prosecutor Matt Bingham
told the jury.
Laney had faced life in prison for the deaths of 8-year-old Joshua and
6-year-old Luke, and the beating of Aaron, now 2.
Bingham pounded his fist in his hand as he recounted Joshua's killing: "He got
strike after strike after strike on his head to the point that his brains were
coming out of his head like liquid."
Defense attorneys argued that insanity was the only reason why a deeply
religious mother who homeschooled her children would kill two of them and maim
another without so much as a tear.
All five mental health experts consulted in the case, including two for the
prosecution and one for the judge, concluded that a severe mental illness caused
Laney to have psychotic delusions that rendered her incapable of knowing right
from wrong during the killings -- the standard in Texas for insanity.
Psychiatrists testified that Laney believed she was divinely chosen by God --
just as Mary was chosen to bear Christ -- to kill her children as a test of
faith and then serve as a witness after the world ended.
Prosecutors portrayed the killings as deceptively planned and coldly executed.
They said that even if Laney believed she was doing right by God, she had to
have known she was doing wrong by state law. Her first call, they pointed out,
was to 911 to summon authorities.

The cases are almost identical. I think that largest part of the
problem is that their insanity was so entwined with their religion
that it had a tendency to be disguised -- before the murder of their
children, that is. Dee Laney even told her pastor that God® spoke to
her and told her that she had been called as a witness to the
Endtimes©, and he thought it was a perfectly normal statement. In
both cases even though the mental aberrations had been going on for
years, no one was able to distinguish between insanity and faith to
recognize that it was a problem until it was too late.

Enough to name their children after Biblical characters. John and
Mary are common enough names, but when you toss in a Noah,
I think it's pretty clear where the names come from.

Maybe this case will cause some changes for the better, but for
some reason, I doubt it. I hate being pessimistic, but in this case I

Yes, especially when, according to anti-smokers, most criminals are
smokers...why not just put them in something like a half-way house...let
them smoke their way out...so to speak...
it could save them a bundle on trying to keep these people alive for 140
years...or longer...just imagine all the tobacco taxes the government will
lose when they lock up all smokers in non-smoking jails...
What a stupid system...

hired a recent jailbird to play drug dealer for a hundred bucks. Gray had a
criminal record, but had never served jail time and had stayed out of trouble
with the law for 13 years. One conviction for "trafficking in cannabis" later,
Gray's wife attempted suicide, while Gray himself spends his time in the
maximum-security prison in Springville.

Caught with one-sixteenth of an ounce of crack in a hotel-room buy set up by an
undercover cop, Van Winkle - twice previously convicted of cocaine possession -
says police forced her into the deal that resulted in a life sentence. Van
Winkle, a pregnant mom, on parole and trying to stay clean, moved into a cheap
motel. It was an area, a county prosecutor told the Kansas City Star, where an
incipient drug ring was brewing. "We wanted to stop it before it got going." A
detective posed as a dealer. Van Winkle says she was offered crack, didn't buy,
didn't want it, and left the drugs behind. Police say she threw the drugs away,
onto the ground, only when she realized it was a bust. "Outrageous government
conduct," said Van Winkle's attorney, taking the case for appeal before the U.S.
Supreme Court. "The government created the crime and orchestrated it from start
to finish." Sentenced under a state three-strikes law, Van Winkle is the only
nonviolent female offender serving life behind Kansas state bars.

was incontrovertible proof that Montgomery dealt drugs. His lawyer charges that
ulterior motives fueled his prosecution - namely, police wanted to convert his
property into a station, but the Montgomerys would not sell. However, because
the wheelchair was inside his house, the Beckham County prosecutor filed
forfeiture papers. (The request was denied under a now expunged Oklahoma law
that excepted homesteader property from seizure.) Montgomery was released in
1995 for health reasons after spending 11 months inside during 1992 and being
returned to prison after his appeal was denied.
COMMONWEALTH v. Calvin White
On November 21, 2003, the Norfolk Circuit Court formally sentenced the defendant
to the jury-imposed verdict of Life plus 28 years in the Virginia State
Penitentiary for First Degree Murder, two counts of Robbery, and two counts of
Use of a Firearm arising out of the April 10, 2002 robbery and murder of one man
(Terrell Gillian) and the robbery of a second man in the 3200 block of Marne
Avenue in the city of Norfolk. The defendant and a second suspect approached
the homicide victim, Terrell Gillian, and the second man and then proceeded to
rob both men. The homicide victim was shot in the back after he was robbed.
The jury convicted the defendant of all charges and recommended a sentence of
Life in prison plus twenty-eight (28) years.
COMMONWEALTH v. Brinny Austin
On November 21, 2003, the Norfolk Circuit Court sentenced the defendant after
having found him guilty of First Degree Murder, Robbery and Use of a Firearm.
This offense took place on May 5, 2002, when the defendant and two co-defendants
robbed the Harbor Freight Tool Store located at 415 North Military Highway,
Norfolk. During the course of the robbery an employee of the store was shot
several times and killed. His body was found the next morning by an assistant
store manager and he was pronounced dead at the scene. Approximately $3000 was
stolen from the store's safe. A latex glove with the defendant's DNA and
gunshot primer residue was found at the scene. The defendant was sentenced to
one-hundred fifteen years (115) in the Virginia State Penitentiary. The
execution of ten (10) years of this sentence was suspended conditioned upon the
defendant completing twenty (20) years of probation upon his release from
prison. The defendant will therefore serve one-hundred five (105) years in
prison.

This was the sentence imposed on Arvin McGee, an innocent prisoner recently
released after DNA evidence cleared him of a 1987 sexual assault in Tulsa. He
spent 14 years behind bars. Fourteen out of three hundred sixty-five, later
"reduced" to 298 years--still a sentence of life in prison until death.
Thank God that Arvin McGee's freedom was won after fourteen years.
And thank God that the 20-year old victim of this crime survived her brutal
attack. For her, for her loved ones, and for Arvin McGee.
Had this unfortunate woman been killed as well as raped and robbed, is there any
doubt that the jury would have sentenced Arvin McGee to death? The jury viewed
the crime worthy of a three-hundred-plus years sentence. If murder were
involved, McGee would surely have been sent to death row.
After fourteen years on death row, where would McGee be now? Quite possibly in a
body bag.
This was not a capital case. This was not a murder.
But if it had been, Oklahoma would have sent yet another innocent man to death
row--and might have already killed him.
A system that hands down lengthy sentences to innocent men is too flawed to be
trusted with the death penalty. If the system cannot guarantee that no innocent
person will be executed-and how can it, looking at what happened to Arvin
McGee?--then the death penalty must be abolished.
Arvin McGee's wrongful imprisonment is a tragedy, and his lost 14 years can
never be replaced. It is no small thing that his liberty, at least, has been
restored.
McGee is the third innocent prisoner released from Oklahoma prisons in under a
year thanks to DNA testing. It is not a stretch to assume that there are other
innocent prisoners convicted of crimes which left no DNA evidence behind.
It is likewise not a stretch to assume that one of these unknown innocents may
be sitting in a cell on death row, and will be executed with his innocence
undiscovered.
When a mistake is made and an innocent prisoner has been sentenced to a lengthy
prison term, liberty can at least be restored. If that prisoner has been
executed, nothing is left but deep, irrevocable shame.
We must face the fact that our system makes the kinds of mistakes that rule out
the death penalty as an acceptable practice.

The trick is to find the balance.
If all personal freedoms are taken away, society will still not be
