Object: ***** killer could get off with a new trial
I was reading this article and didn't remember this ***** but couldn't help
but notice that this entire article was filled with crimes of "Typical
***** Behavior" which definately showed that it was talking about a *****.
So I did a little research and sure enough... I found his picture.
It is a good thing we locked him up for good. It will prevent him from more
crimes just as serious and he will not be able to breed more nigglets. It
is a shame however that they are thinking about a new trial, I can just see
him at an older age or perhaps even one of his future children raping and
robbing left and right.
Here are some excerpts which made me realise that this was a *****...
Lionel was convicted of killing Tiffany Eunick, 6, by stomping on her
48-pound body so forcefully that her liver lacerated.
Well now, wasn't that interesting. What is it about niggers that makes them
so violent?
Mr. Bush would not consider clemency earlier, partly because of Lionel's
problems in prison, which reportedly include kicking a guard and
insubordination.
And this is the type of person we want to give a new trial to? Do we really
want someone so violent to have another chance?

MIAMI, Dec. 10 - A Florida appeals court panel ordered a new trial on
Wednesday for Lionel Tate, whose life prison sentence for murdering a
playmate when he was 12 became an international rallying point against
treating juvenile offenders as harshly as adults.
A three-judge panel of the Fourth District Court of Appeals reversed the
conviction and life sentence of Lionel, now 16, on grounds that his mental
competency should have been evaluated before his trial in 2001. The boy's
lawyers had sought such an evaluation, though only after the conviction for
first-degree murder, which in Florida requires a life sentence with no
parole regardless of the defendant's age.
"This is as good as it gets, to get a do-over," one of Lionel's appeals
lawyers, Cheryl Zickler, said on Wednesday. "We have more facts than we did
the first time around. So this time, everyone will be much more informed."
The life sentence mobilized protesters who said no child should be locked
away for life, no matter the crime. Lionel was convicted of killing Tiffany
Eunick, 6, by stomping on her 48-pound body so forcefully that her liver
lacerated. He is believed to be the youngest American to receive a life
sentence.
At the trial, his lawyers said that he had been play wrestling and that the
killing, which occurred in his house near Fort Lauderdale as his mother
slept upstairs, was accidental. Prosecutors argued that Tiffany's extensive
injuries showed intent to harm.
On Tuesday, a lawyer for Lionel said that clemency was "a dead issue right
now" and that Gov. Jeb Bush echoed that view.
Lionel's lawyers had also requested an expedited clemency hearing that could
result in a much shorter sentence. But Mr. Bush delayed action during the
appeals. Mr. Bush would not consider clemency earlier, partly because of
Lionel's problems in prison, which reportedly include kicking a guard and
insubordination.
Lionel's trial lawyer, Jim Lewis, said he did not request an evaluation
because a finding of incompetence would have required Lionel to be sent to a
state mental institution.
"Until the court matter is resolved," Governor Bush told reporters in Miami,
"we will not take action on the clemency request. When it is complete and we
have an understanding of what his status is, then we would make the
determination as to whether or not to go forward. In the meantime, we hope
that young Lionel is progressing and developing in maturity and that he is
abiding by the rules."
He will remain at the maximum-security Okeechobee juvenile jail for at least
15 days, when the state can request a rehearing of the appeal. If the state
does not do so, Lionel's lawyers said, they will immediately file a motion
to release him on bond pending the outcome of his new trial.
Ms. Zickler and her co-counsel, Richard Rosenbaum, who became Lionel's
lawyers after the verdict, said that they had a conference call with Lionel
and his mother, Kathleen Grossett-Tate, after learning of the reversal and
that Ms. Grossett-Tate, on duty in Puerto Rico as a member of the Army
Reserve, had sobbed.
"Lionel's first word was, `Fantastic,' " Mr. Rosenbaum said. "We could hear
cheering in background from some of the guards and prison staff who were
rooting for him."
This was the first of three highly publicized cases that put Florida at the
center of a heated debate over prosecuting youngsters as adults. In one,
Nathaniel Brazill of West Palm Beach was convicted of second-degree murder
and sentenced to 28 years in prison in 2001 for shooting his teacher. He was
13 at the time.
In the other, Derek and Alex King were convicted of second-degree murder
last year for bludgeoning their father to death with a baseball bat in 2001,
when they were 13 and 12. The verdict was overturned because the judge found
that their rights to a fair trial had been violated, when the prosecutor
separately tried a friend of their family for the same crime.
Lionel and his mother insisted that he was innocent and turned down a plea
agreement before his first trial that would have limited his sentence to
three years.

The WHITE wrestlers he saw on TV, and was emulating?

Put a retarded child in an adult prison and fault him for acting like
a retarded child. That's showing intelligence, trailer trash.
Intelligence that can only come from the inbreeding it's evident
you're the result of.

And this is the type of person we want to give a new trial to? Do we really

Do we really want to have fair trials? I guess you don't.
