ACLU Backs Student Offended By Religion In Class
(CBS/AP) NEWARK The American Civil Liberties union is backing a Kearny
High School student who objected when a teacher made religious
statements in the classroom, including allegedly telling students that
those who do not believe Jesus died for their sins belong in hell.
The student's lawyers filed a notice of claim on Feb. 13 against the
school district, claiming that instead of addressing the teacher's
conduct, it penalized the student for secretly taping the teacher.
"I believe it is important to stand up for our constitutional rights and
to make sure that these violations of the First Amendment, which
apparently have been going on for years, are stopped once and for all,"
junior Matthew LaClair said at a news conference Monday in Newark.
Starting in September, LaClair complained to the school administrators
about comments made by his history teacher, David Paszkiewicz. LaClair
said the teacher presented his own personal religious views and beliefs,
and denigrated differing viewpoints.
Among other things, the student claimed, the teacher told students
evolution is less fact-based than the Bible, there were dinosaurs on
Noah's Ark, the Big Bang theory of creation is unscientific, and that
the Bible has been proven to be literally true by the fulfillment of
Biblical prophecies.
School board president Bernadette McDonald said the district has
repeatedly worked with LaClair's family to address their c concerns.
"Our district fully supports and takes seriously its obligation to
ensure that the personal religious beliefs of our professional staff
stay out of the classroom," she said in a written statement. "The Kearny
school district has abided by, and will continue to abide by, both the
spirit and the letter of this Constitutional mandate."
She said the school took corrective action once the problem surfaced,
but did not specify what it was.
"We took his concerns very seriously," she said. "The result was that we
have received no further complaints about such religious proselytization
in our schools."
McDonald said the school plans mandatory training for staff on what is
and is not acceptable discussions about religion in the classroom. The
district plans to unveil a policy Tuesday night reaffirming its
commitment to the separation of church and state in the classroom.
A message left at Paszkiewicz's home was not immediately returned.
According to the ACLU, during a meeting with LaClair, the school
principal and the department head, the teacher denied making many of
these statements or suggested that in his view they were part of a
legitimate in-class discussion.
Knowing he might not be believed, Matthew had recorded the teachers
statements during class and provided those recordings to the principal.
After that, school officials ended the meeting and declined to further
discuss with LaClair or his parents what actions would be taken to
correct the problem, the ACLU said.
LaClair said he was subjected to harassment from other students, which
the school failed to halt. The school also switched out all the students
in Paszkiewicz's class, provoking hostility toward Matthew for having
caused a midyear change in teachers, his lawyers said.
McDonald said the district has hired Edwin H. Stier, a former director
of the New Jersey Division of Criminal Justice, to investigate the
student's claims of harassment.
"This episode was a test for Kearny school officials, one which they did
not pass," said Andrew Stengel, an official with the People For the
American Way Foundation, a liberal advocacy group. "For failing to
uphold religious freedom and tolerance, and for failing to support a
student who took a principled stand, we give the school board an F."
The notice of claim is a first step required before suing a public
agency in New Jersey.
Kearny, N.J., is located about 13 miles from Manhattan.

That's true. This has made the news before. I wonder how that was
received. Many students these days use tape recorders in lieu of
notebooks.

The teacher is just plain dishonest - he said, "well, you got the
Christian" after he had been caught lying that he hadn't done it, when
the CDs were played back to him in the Principal's office.
As though he had been set up - when even if he had been there
shouldn't even have been anything to set up. He set himself up.
I got this from the horse's mouth when the kid and his father were at
a NYC atheists meeting.
What is scary is that this isn't even in the boondocks but the New
York metropolitan area.

I know, Kearny isn't too far from where I went to school though I
can't imagine my High School having a teacher like this (admittedly at
least 10% of my school's population was Jewish which would stop any
outspoken Christian proselytizers lasting long).
Admittedly most in the town did assume one had to be religious of some
sort. When we moved away the town council passed a resolution
thanking my mother for her service to the community and listed her
support of the local UU church (my mother was not a member so I guess
knowing she wasn't actively Jewish, Catholic, or attending any other
local church they chose the catchall church).

Don't be so deliberately stupid. The teacher lied about evolution,
prosetylised and told an atheist kid he was going to hell.

Or as an example of a fulfilled prophecy (T must be Tyre)

and the men of the sea would be slaughtered, and it would be known as
a place were fishermen mend their nets (??). You can look it up in the
older Encyclopedia Brittanica, look up T-, and it will say that it's a
place where fishermen mend their nets. Not the newest one, but the
older one, the ones they had the old [???]. Alexander the Great comes
down the scene of history. He's not a military guy, he's a soldier. He
gets to T-, he wants to conquer the city, and he is so frustrated that
the city has escaped. And he's [??] that, he has his men take every
stone of the city and throw it into the sea to build a causeline from
the mainland to Little T- and slaughters the men of the city.
Unfortunately Ezekiel specifically said Nebuchadrez'zar would destroy
Tyre not Alexander.
[7] "For thus says the Lord GOD: Behold, I will bring upon Tyre from
the north Nebuchadrez'zar king of Babylon, king of kings, with horses
and chariots, and with horsemen and a host of many soldiers.

[11] With the hoofs of his horses he will trample all your streets; he

Nebuchadrez'zar never took it as Ezekiel admits in a later chapter.
