AG opinion a Victory for Elected State Board of Education

The elected, conservative State Board of Education will get more authority
to over public school textbooks, thanks to a recent opinion by Atty. Gen.
Greg Abbott (R).
Abbott has decided to allow the board to enforce a section of the Texas
education code that allows the State Board of Education to insist that
textbooks foster an appreciation of the United States of America. The Texas
Education Code, Sect. 28.002(h) states: “The State Board of Education and
each school district shall foster the continuation of the tradition of
teaching United States and Texas history and the free enterprise system in
regular subject matter and in reading courses and in the adoption of
textbooks. A primary purpose of the public school curriculum is to prepare
thoughtful, active citizens who understand the importance of patriotism and
can function productively in a free enterprise society with appreciation
for the basic democratic values of our state and national heritage.”
The opinion reverses a 1996 attorney general’s opinion by former Atty. Gen.
Dan Morales (D), held the board had no authority to evaluate patriotism in
books. “We believe that subsection (h) is intended to serve as an
indication of legislative policy and a guide for the board and school
districts in formulating their curriculum, and that it does not confer any
additional power to the board with respect to textbook adoption.”
The Abbott opinion, by contrast, states that textbooks must comply with
28.002(h) regarding U.S. and Texas history.. .
