Alito's Statements on Abortion in 1985 Job Application Raise
Concerns Among Senators, Ensure Questioning During Hearings
Supreme Court nominee Judge Samuel Alito's statement that the
"Constitution does not protect a right to an abortion," which he made
in a 1985 job application for a position in the Department of Justice,
has raised concerns among some senators about whether he still holds
or exaggerated those beliefs and has ensured that he will be directly
questioned on the issue during the upcoming Senate confirmation
hearings, the Los Angeles Times reports (Serrano/Savage, Los Angeles
Times, 11/15). Alito in a 1985 application to become deputy assistant
to former Attorney General Edwin Meese wrote that he "personally
believe[s] very strongly" in the legal position that abortion is not a
constitutionally protected right. Speaking of his service as an
assistant to former Solicitor General Rex Lee in the Reagan
administration, Alito wrote, "I am particularly proud of my
contributions in recent cases in which the government has argued in
the Supreme Court that racial and ethnic quotas should not be allowed
and that the Constitution does not protect a right to an abortion." In
addition, he wrote, "I disagree strenuously with the usurpation by the
judiciary of decision-making authority that should be exercised by the
branches of government responsible to the electorate" (Kaiser Daily
Women's Health Policy Report, 11/14). Alito's personal views on
overturning Roe v. Wade -- the 1973 Supreme Court case that
effectively outlawed state abortion bans -- recently have been debated
among antiabortion groups, several of which have evaluated his rulings
on four abortion-related cases as ruling "against pro-life positions
three times" (Kaiser Daily Women's Health Policy Report, 11/11).
President Bush last month nominated Alito to replace retiring Supreme
Court Justice Sandra Day O'Connor, who has said she will remain on the
court until her successor is confirmed (Kaiser Daily Women's Health
Policy Report, 11/14).
Reaction
Some Democratic members of the Senate Judiciary Committee on Monday
"seized on the application as evidence" that Alito would take an
"ideological agenda to the bench," the New York Times reports. Sen.
Patrick Leahy (D-Vt.), the ranking Democrat on the committee, said the
document showed "an eager and early partisan in the ranks of
ideological activists in his party's extreme right wing" (Kirkpatrick,
New York Times, 11/15). Committee Chair Arlen Specter (R-Pa.) said
Alito's statements gave him "more reason to question him closely"
during the hearings, but Specter added, "People do shift, so there may
be an evolution of his thinking. ... I don't think we know at this
point what Alito would do with Roe nor should we be able to ask him
head on" (Rowley, Bloomberg/Philadelphia Inquirer, 11/15). Steve
Schmidt, a spokesperson for the Bush administration, said that Alito's
"record shows a clear pattern of modesty, respect for precedent and
judicial restraint" (Sammon/Hurt, Washington Times, 11/15). He added,
"Anybody who would read this letter from 20 years ago as an indication
that he would overturn Roe v. Wade is jumping to conclusions"
(Biskupic/Stone, USA Today, 11/15). Sen. John Cornyn (R-Tex.), a
member of the Judiciary Committee, said, "I'm not sure it is news that
Judge Alito is pro-life, nor that Roe v. Wade was poorly reasoned"
(Becker/Babington, Washington Post, 11/15). However, Cornyn added that
Alito's 15-year track record on the 3rd U.S. Circuit Court of Appeals
showed he is able to put aside his personal views on abortion rights.
"I have every confidence he will continue to do so if he is confirmed
to the United States Supreme Court," Cornyn said (New York Times,
11/15). Alito's confirmation hearings are scheduled to begin on Jan.
9, 2006 (Kaiser Daily Women's Health Policy Report, 11/14).

Maybe there is a fine distinction between brown-nosing and lying but if
I were hiring and an thought an applicant was telling me things that he
thought I wanted to hear, true or not, I would be very suspicious. I
might not reject him out of hand, but would be extra careful about
checking references.
