According to the story, the judge had the latitude to sentence from 5 to 10
years for the offense. The judge chose to sentence for 10 years, which is
the max of his discretion in the matter. What's the big deal. The judge
should not have said why he elected to sentence to the max, but he did, and
he did not exceed his sentencing powers.
Perhaps the judge should have simply said that he had the ability to
sentence for up to 10 years, so that's what he was going to do, and not said
why. The story you posted does not give us the detail as to what the
sentencing considerations were, it only says that the judge set the sentence
at the max of his descretion.
Obviously, the criminal is not pleased with drawing the max sentence, but
that's what happens sometimes. You screw up and you go to jail. It appears
that the man was not sentenced for being Christian, he was sentenced to to
years because he represented himself as Christian to his victims, and they
had a reasonable expectation of certain behavior and a level of
trustworthiness that simply was not there. The guy said, in effect, I'm a
good guy and you can trust me, then he cheated. That's why the judge gave
him 10 years.
