I get nervous when the government claims the ability to punish for

Yes.
If someone is attacked because they are black, the only way
a black person can avoid such a fate is if they stop being
black. If, on the other hand, someone it attcked because they
are wearing an expensive watch, all they have to do is stop
wearing the expensive watch.
Clearly there is a difference.

Not a good path to tread.
Adding to a crime's sentencing because of reasons is not new. It is the
difference between murder and manslaughter. If you think about it,
premeditation makes a crime murder, even if the premeditation is only just
before the crime. That, in essence, is thought. This is no different.
Making "hate crimes" a statute is in direct response to people claiming that
the person of whatever group deserved to die based purely on that membership
in said group. "I was once beaten up by a black man, so I couldn't help
myself."
And, no, not all violent crimes are about hate. There is greed. There is
convenience (Lacy was in the way). There is power. The reasons behind
crime are endless. And they are always part of the prosecution.

When I was growing up, I was taught "No means no" and to use
"NO" forcefully if I was in a situation I didn't like. What is so hard
about saying "NO?" A lot of women have done it at one time or another.
