Robertson, who heads the Virginia Beach-based Christian Broadcasting

VIRGINIA BEACH, Va. (AP) - The U.S. State Department has condemned an
on-air suggestion by religious broadcaster Pat Robertson that the
agency ought to be blown up with a nuclear device.
(rest snipped)
Robertson's comments would appear to be in violation of Section 930(c) of Title
18, US Code as modified by Section 811(b)2 of the Patriot Act. This provision
regards killings or attempting or conspiring to kill in a federal facility. The
Patriot Act added the "attempting or conspiring to kill" part to the code, thus
making Robertson's conduct equivalent to a first-degree murder charge. The
punishment is specified in Sections 1111 of Title 18, US Code. This is also one
of the provisions of the law that Osama Bin Laden is being charged with.
It can be interpreted that Robertson can get the Federal death penalty under
the provisions of Section 1111 Title 18 USC for his comments. It is more likely
that he will get the lesser charge of 5 years under Section 930(c) if
prosecuted.
Of course, since the extremist right loves Robertson and will bend over
backwards to please him, he will likely never be prosecuted for anything that
he says or does...just like the people who helped terrorist James Kopp.
