That's good. Such criteria could form the basis of the "final
solution". Get your jack boots ready.

The United States has not permitted torture of suspects as its policy
is a 'rule of law'.
A private individual cannot be an enemy combatant since only Nation
States are recognised to have armies. Anyone else is a common criminal.
Torture historically has a bad record for getting true and useful
information. It has an excellent reputation for getting what you want
to here.
A citizen of a country has a reasonable expectation that his Government
will abide by its own laws in dealing with him and will not hand him
over to a foreign government to enable illegal acts.
If the government is sure of his guilt and the legality of its 'enemy
combatant' legislation they should simply have convened a military
court and had the person convicted and executed. 10 minutes tops for
the 'trial'.

They found a nice way around that: Let the rankers do it. Until
someone blows the wistle, watch it as Ray Charles does. Then let the
rankers take the blame.

If I recall correctly, most Indian tribes were not considered nation
states. The several 100.000 Pino's who got tortured to death (early
1900's, AFTER the Spanish war) were all common criminals?

That entirely depends. A Vichy Frenchman would not expect that at all,
nor would a present day Iraqi.
If the government is sure of his guilt and the legality of its 'enemy
combatant' legislation they should simply have convened a military
court and had the person convicted and executed. 10 minutes tops for

Doesn't work that easy.

That explains why they were bringing charges about the abuses *before* the
story got splashed all over the media.

Let me explain this one more time.. torture is useless as an
interrogation tool because the person being tortured will say whatever
it takes to get the torture to stop.
With my training, I could get you to admit to being an al-Qaeda
operative in a few hours. There's this fun trick with a hand-cranked
field phone. Split the wires, tape one strand to the genitals, the
other to either a nipple or wrap it around a tooth (be sure to tape
the mouth shut!) Crank the phone. After your victim stops screaming
and wetting himself, explain that unless he confessess, you'll
increase the duration.
Think you could take that?

There is also another flaw with torture when it comes to the real deal
real terrorists. Suicide bombers prepare themselves mentally to die or
to suffer terribly in the unintended event of survival. Zealots are
not broken by torture but are affirmed in their beliefs. They realise
that although they can be made to suffer physically by the hands of
others that mental suffering can be a matter of choice that can be
deny others' influence.
Only the falsely accused or the politically defined "terrorists" will
confess under torture to what they probably did not do.
