Woman arrested while protesting Bush speech released under First
Amendment
MONTGOMERY, Ala.
A woman arrested for holding an anti-war poster at Auburn University
Montgomery during President Bush's Social Security speech last week
was released by a Montgomery magistrate, who said the protester was
expressing her right to free speech.
According to a police report, the woman was handcuffed because she
refused to protest inside a predetermined area on campus where other
protesters demonstrated.
The woman held a sign reading "Stop the War!" outside the gym where
Bush was speaking last Thursday.
She refused to give her name to authorities and is listed as Jane Doe
in court documents.
She was released from the Montgomery County jail Thursday evening when
Chief Magistrate Patrick Murphy said the sign was a form of free
speech protected by the First Amendment.
Murphy said the woman did not have to identify herself because there
was no probable cause she committed a crime.
A-U-M spokesman Lee Bridges said the officers asked the woman to limit
her protesting to the campus "free speech zone" -- an area designated
by school policy for protests in general.

That's a very important ruling. It could be used to neutralize these evil
free speech zone rules that have been popping up all over. And it also flies
in the face of the Patriot Act, since the judge ruled that you don't have to
identify yourself when there isn't probable cause.

The number of innocent people who have been smashed to the ground,
ordered onto their face at gunpoint, and/or dragged away in handcuffs
merely for exercising the old U. S. Constitution before this fascist
regime is uncountable, it's happened so often.

Which, very sad to say, were invented under the Clinton administration, in
response to the WTO protests in Seattle in 1999.
And it also flies
in the face of the Patriot Act, since the judge ruled that you don't have to
