SAN FRANCISCO - A suburban San Diego teenager who was barred from wearing a
T-shirt with anti-gay rhetoric to class lost a bid to have his high school's
dress code suspended Thursday after a federal appeals court ruled the school
could restrict what students wear to prevent disruptions.
The ruling by the San Francisco-based 9th U.S. Circuit Court of Appeals
addressed only the narrow issue of whether the dress code should be
unenforced pending the outcome of the student's lawsuit.
A majority of judges said, however, that Tyler Chase Harper was unlikely to
prevail on claims that the Poway Unified School District violated his First
Amendment rights to freedom of speech and religion for keeping him out of
class when he wore a shirt with the message "homosexuality is shameful."
Tyler Chase Harper sued the Poway Unified School District in San Diego
federal court after the principal at Poway High School refused to let the
student attend class wearing a T-shirt scrawled with the message
"homosexuality is shameful."
Harper was a sophomore at Poway High in 2004 when he wore the T-shirt the
day after a group called the Gay-Straight Alliance held a "Day of Silence"
to protest intolerance of gays and lesbians. The year before, the campus was
disrupted by protests and conflicts between students over the Day of
Silence.
After Harper refused to take off the T-shirt, Poway High School's principal
kept Harper out of class and assigned him to do homework in a conference
room for the rest of the day. He was not suspended from school

fucking pants away from her! I shot the principal a terse E-mail
warning her next time to send my child home before she takes her pants
away from her. I even threatened civil action.

I hate dress codes. I think it's discrimination. My younger daughter
had her pants taken away from her because they had rips in them. That's
in fashion these days! Well, screw the discrimination, they took her
fucking pants away from her! I shot the principal a terse E-mail
warning her next time to send my child home before she takes her pants
away from her. I even threatened civil action.
Uhm, not to be nosy, but I'm assuming she was given replacement pants
to wear, right?
Gym shorts from her locker, of course...
Get out!
The pants were bad, but those revealing gym shorts were ok? What
flavor of crack was that ***** principal smoking, because I want to
avoid it.

to protest intolerance of gays and lesbians. The year before, the campus was
disrupted by protests and conflicts between students over the Day of
Silence.
After Harper refused to take off the T-shirt, Poway High School's principal
kept Harper out of class and assigned him to do homework in a conference
room for the rest of the day. He was not suspended from school
I think that Bill Clinton got it right (yes, that's right, I said that)
in terms of advocating school uniforms for public schools. Schools are
not the place for unrestricted expression, they are there for children
to learn. Students do not have the same rights as adults, in that the
school is acting as their guardian during the school day. We should not
tolerate displays that detract from the school's mission.

would violate their "freedom of speech."
It's a school. Kids do not have full rights in schools. They are,
for example, subject to certain rules designed to ensure the
institution as a whole operates smoothly and safely. Promulgation of
religious hate is not protected speech, no matter how they spin it.
How about a t-shirt saying "Black is shameful."

Hate speech usually is protected outside of K-12 settings. The only
additional circumstances which warrant restrictions in K-12 (Tinker -

are words which would substantially interfere with 1) school discipline
or 2) the rights of others. Hate speech may or may not qualify
depending on the details - and it is the details that make this ruling
controversial.
How about a t-shirt saying "Black is shameful."
If it disrupted school discipline, it is not protected. Otherwise, it
is not clear if it violates the "rights of others".

Civil liberty for right wingers is about as productive as freedom for a
prisoner..
Ask the Christian Coalition (www.cc.org).
They provide legal and even financial assistance to people who kill doctors,
bomb clinics, and such.
When the Abu Ghraib terrorists were charged for their crimes - the Coalition
was all over it - volunteering any way they could.
They used to have non-profit status.
They got it by calling themselves a christian ministry or church or
somesuch.
About 20 yrs ago, they were reclassified when the courts were notified that
they were not a church.
That's why you don't hear much about right-wing defenders of civil
liberties.
They are morally opposed to civil liberties - and end up losing their own.
You might just as well move to Bush's Afghanistan for it's religious
freedom.
