Court Upholds Christian School's Right to Fire 'Gay' Teacher
By Emma Elliott
Teacher had sued, claiming 'sexual orientation' discrimination.
The original intent of the Founding Fathers was upheld this week by an
appeals court in Minnesota, reports the Pioneer Press of St. Paul. The
ruling blocked a "gay" teacher's attempt to sue the Christian
school that discharged him because of his homosexuality.
"This was clear-cut," said Robert Knight, director of Concerned
Women for America's (CWA's) Culture & Family Institute: "If a
church school can't tell a teacher not to flout Biblical morality,
the school might as well go out of business, which is what the ACLU and
other God-haters are really trying to accomplish. The court rejected
the activist role that other courts have taken, and wisely upheld the
First Amendment rights of the Lutherans to determine their own
standards."
The teacher, referred to as John FR Doe in the court's ruling, was
ordained as a minister by Lutheran Church-Missouri Synod in 1973.
According to court documents, he served as campus pastor to the
Lutheran High School of Greater Minnesota in Bloomington from 1976 to
1979. He returned to that position in 1993. His duties included
conducting school chapel services and counseling students. When his
homosexuality became known to the bishop of Doe's synod, Doe was
asked to resign. He then sued the high school and the Lutheran
Church-Missouri Synod for discrimination.
The Lutheran High School of Greater Minnesota is affiliated with the
Lutheran Church-Missouri Synod. Lutheran schools make up the largest
Protestant parochial school system in the United States.
The Lutheran Church-Missouri Synod has taken an unequivocal stance
against homosexuality. According to court documents, the synod in 1973
called homosexual behavior "intrinsically sinful." In 1999 it
published a document titled "A plan for Ministry to Homosexuals and
Their Families," which describes homosexuality as "the tragic
result of original sin."
The Minnesota State Court of Appeals on Tuesday upheld a district
court's decision that hearing Doe's suit would violate the
separation of church and state.
"We all talk about the separation of church and state. This is what
it's all about," said the school's attorney William Hart to the
Pioneer Press. "People don't have the right to challenge church
doctrine in court. Otherwise, the state would define what religions
could and could not believe."
The Supreme Court's 1971 decision Lemon v. Kurtzman set the standard
for determining if a state action violates the First Amendment.
According to the so-called Lemon test, the government's action must
have a secular purpose, must not advance or inhibit religion and must
not excessively entangle government with religion. If the action meets
these three criteria, it is constitutional.
In accordance with this precedent, the Minnesota Court of Appeals ruled
that it may not decide whether or not Doe's discharge was
discriminatory. His lawsuit would force the court to conduct a
"searching inquiry" into a church's doctrine and administration.
This would violate the Lemon test's third criteria of avoiding
"excessive entanglement."
Doe also argued the high school's actions violated the Minnesota
Human Rights Act, which prohibits discharge based on "sexual
orientation." Religious associations, however, are exempt from this
prohibition. The court rejected Doe's argument that the high school
and the synod do not qualify for the exemption.
In making this determination, the court relied on a 2004 case involving
a mailroom employee discharged from the Billy Graham Evangelistic
Association. That decision established that the Minnesota Human Rights
Act exemption also applied to nonprofit religious organizations engaged
in a religious business activity.
It is not yet known if Doe will appeal the decision.
Reflecting on the court's decision, David Strand, Director of Public
Affairs for the Lutheran Church-Missouri Synod, said, "Of course
we're sad that someone lost their job, but we're very relieved the
court upheld our First Amendment rights."

What's even funnier is the dodo's who think that the rcc priests are
"christian priests!" And your percentage is wrong, even though you
made it up on the spot. The real percentage is 1.18725% of course.
The Bible condemns homosexual behavior.
Why would the government intrude on a religion's right to remove a
"teacher" from its midst that does not believe what it does?
I thought it was the homosexuals who tried so hard to separate church
and state!

The Bible does not give a blanket "no - remarriage" rule to folks who
are divorced.
And you may divorce your spouse under certain conditions, Biblically.

Yeah, that whole "looking = adultery" thing sort of made such a rule
superfluous.

Quite true -- if the partner had been unfaithful, then divorce followed

Are you suggesting that most divorced Christians have been cuckolded?

Hi Cary,
IF a person really is a Christian, then he/she would not likely
divorce his/her spouse. Not a solid rule, but a reasonable
generality.
IF a person cheats on their spouse, that person is likely not a
Christian.

The botton five were Massachusetts, Connecticut, New Jersey,
Rhode Island, and New York. California was 30th.

Court Upholds Christian School's Right to Fire 'Gay' Teacher
By Emma Elliott
Teacher had sued, claiming 'sexual orientation' discrimination.
That's halarious! 95% of christian priests are gay and they fire a teacher!
Whoooa, what a funny cult.
If these self-same Christian schools were as quick to fire
any divorced teacher the instant he re-married, your
rationale would be far more convincing.
The Bible does not give a blanket "no - remarriage" rule to folks who
are divorced.
And you may divorce your spouse under certain conditions, Biblically.
Quite true -- if the partner had been unfaithful, then divorce followed
by remarriage is allowed.
Are you suggesting that most divorced Christians have been cuckolded?
Cheated on by their -- presumably -- Christian spouses?
Hi Cary,
IF a person really is a Christian, then he/she would not likely
divorce his/her spouse. Not a solid rule, but a reasonable
generality.
IF a person cheats on their spouse, that person is likely not a
Christian.
Well, I must point out that divorce rates in the Bible Belt (whence
I came) are famously the highest in the nation.
Sad, but 100% true.
Now, the question might be, "What constitutes a "Christian""
Christian ( happily married and faithful to my spouse for almost 39
years now)
That is most admirable. It's always nice to see.
I find that I (an atheist) have not even the inclination
to cheat on my beloved. (on the other hand I do look --
or as a girlfried expressed it 'you don't look; you LOOK" --
so going by Jesus I'm likely a serial repeat adulterer. Daily)

Yes, but then you get into the No True Scotsman scenario.
"Christians don't commit murder."
"This man killed his family in the name of Christ!"
"He wasn't a true Christian(tm)."
So what makes a true Christian? Let's just go with the definition Paul
gave: "That if thou shalt confess with thy mouth the Lord Jesus, and
shalt believe in thine heart that God hath raised him from the dead,
thou shalt be saved."
I think the Southerners have that covered pretty well. So they're
Christians that are either adulterers or wrongful divorcees, according
to their creed.

All sin
None are righteous.
Blatantly continuing in a sin is evidence that one is not a Christian.
Real Christians would have a lower incidence of divorce.
There is ALWAYS the case of the mismatch, one is, one isn't.
Going to church a few times a year is no indicator whatever.
God chooses.
"Believe in thine heart" is an absolute statement and has nothing to do
with originating words.
Many who have said Lord Lord and performed miracles in His name will
never see heaven, at least that is what Jesus said.
It takes a whole bible.

All sin
I don't!
None are righteous.
Agreed.
Blatantly continuing in a sin is evidence that one is not a Christian.
Not necessarily. When I was a Christian I still 'sinned'. And everybody
I knew still sinned. We all struggled with our own vices. In fact, I
never met anybody as a Christian that claimed to be free of sin. It's
only since I stopped being one that every single one of them is
miraculously free of sin, and thus able to judge me.
Real Christians would have a lower incidence of divorce.
No true Scotsman fallacy.
There is ALWAYS the case of the mismatch, one is, one isn't.
Always? Well there's the problem. Isn't it written "Do not be unequally
yoked"? So that's another of your god's commands that they're breaking.
These Christians really are bad at this following orders thing.
Going to church a few times a year is no indicator whatever.
Neither is going to church weekly. Neither is giving 10% or 20% of your
income. Neither is reading your Bible every night. Neither is building
homes in a church mission trip. Neither is voting for the candidate
that claims the backing of god. So what makes someone a Christian?
God chooses.
And why should a thinking individual put their fate in the hands of
someone known for commiting genocide and punishing its devoted
followers?
It's hardly moral to support such a being. Even less so because you're
scared of its punishment. In fact, if you find the evidence for the
existence of this being so compelling that it cannot be ignored, the
only moral thing to do would be to hold it to account for the crimes it
has committed.
"Believe in thine heart" is an absolute statement and has nothing to do
with originating words.
So what does "Believe in thine heart" mean, really?
Many who have said Lord Lord and performed miracles in His name will
never see heaven, at least that is what Jesus said.
You know, I predict that he was right: none will see heaven.
It takes a whole bible.
For what?
And are you including the parts that show God as cruel and petty? And
the commands on sacrificing goats and sheep?
How about the assertion that God, apparently feeling bad for what a
jackass he'd been in the Old Testament, sets up an elaborate scheme to
save his creations from his anger in which he fucks his own mother so
she can have himself, and commits suicide by cop, all while leaving no
trail for any except his inexplicably divided followers? And that he
expects everybody to believe (on penalty of Hell) in this apparently
purposefully outlandish tail, even though a great multitude had never
heard it and many more value their capacities of reason highly enough
to want the evidence which God was so careful to hide? I mean, you want
to include it all, right?
