DMCA complaints by hate filled bigot? |
This one's rather strange... I don't recognize the hate spew text,
or the name Philip Bartlett but a Google check for "philip bartlett
homosexuality" turns up what looks like copies of unsolicited hate
spew emailed to me some three years ago. There's nothing in my Fundy
Rants archives covering this kook so perhaps he or she routinely
goes through Google searching for its name.
Emailed hate spew... I wonder if kooks can claim their unsolicited
hate rants can some how stand claims of copyright violation inasmuch
as forwarding and exposing it doesn't violate any of the copyright
laws.

unintellectual commentary and random
shots about the fact that I am "crazy". The fact is, you are insane and
crazy for not assuming that this
complex universe has a creator. That is why you are all without excuse.
Your skeptical mind is nothing other
than an old lie of satan. For he said to Eve in the Garden "ye shall be
as gods". This is indeed what you draw
out of the myth of Pandora. What baffles me is that you use a human myth
to provide the motivation for your
own battle of "skepticism". You haven't the faintest idea that it is not
craziness that draws humans to notions
of belief in an advanced deity, but an innate desire to glorify God in
His creation. That is the end for which
God created the world, to glorify Himself through justice on sinners, and
through mercy on those upon
whom Fie has wished to show mercy.
Your battle to vindicate the perversion of homosexuality will come to no
effect. I am adamantly opposed to
racism, and the sacred writ makes it abundantly clear that skin colour
has nothing to do with salvation, for
Christ Jesus came to save a remnant out of every Gentile nation. However,
homosexuality is a BEHAVIOR

away to be saved, through Jesus
Christ. This salvation is free to all who are willing to accept it, and
those who accept it were chosen from
before the foundation of the world. Salvation is by grace and mercy, that

that have fallen short of the glory of God. Scientology and evil cults I
applaud your efforts against, but your
denial of a creator defies all logic and intelligence. Everything around
you testifies against you now, and will
testify against you on the last day, when your mouths are shut and you
see yourselves for what you really
are: all the while miserable wretches in need of a savior, and too proud
to admit that neither you, nor anyone,
has what it takes to be gods. Repent of your skepticism of Jesus Christ,

threats about guns, weaponry, and
cursings. if that continues all of you will be reported to the
authorities. If you wish to relate something, then

Ask a lawyer, but I think if they failed to defend their copyright in the
past, they can't selectively attack someone they don't like who quotes it
now. Plus there is a Fair Use question.

Ask a lawyer, but I think if they failed to defend their copyright in the
past, they can't selectively attack someone they don't like who quotes it
now. Plus there is a Fair Use question.
It was apparently one-off hate spew, not something that the individual
sends copies to as spam. But yes, all prongs of the Fair Use docrine
allow for the forwarding of any such email. Hate speech can't be covered
up simply by claiming it's "copyrighted." Bigots can't send unsolicited
hate mail and expect the people they send it to to not expose the bigot.

Not true.
(Okay, my "qualifications" are being an author and copyright law is
something I've had to keep up with)
Anyway, it's been true since we conformed to the Berne convention that
your copyright *not lost for much of *any reason. The presumption is on
the side of the creator (of course it can get sticky proving you are the
creator if you're not careful but by law, you're considered protected the
moment you write something, period).
The DMCA added the ever so interesting "safe harbor" provisions for
providers that enables them to avoid liability (in whatever legal fight
ensues) by a take down within a handful of days after the take down
request. It doesn't matter anymore whether the claim is good, bad, stupid,
dishonest, or even nuts. To avoid liability, you do the take down. Period.
In other words, guilt is assumed, innocence must be proven.
Now, the law doesn't *put it that way but that is the effect. And I
believe the *intended effect considering the corporations behind the law's
crafting. They couldn't overtly reverse our legal system's presumption of
innocence so they went *around it.

Don't know. But they're doing the take down. I tried searching Google for
the messages (using the message ids) and got DMCA notices.
And I see a search with "philip bartlett homosexuality" now turns up
nothing but your current post.
Google is losing my respect *so *fast...
