A former headmaster of a Western Cape Catholic School, who has been
sentenced to seven years in prison for the rape of a nun five years
ago, has been released on R1 000 bail pending an appeal against his
conviction and sentence.
The man, Jeremiah February, had also been involved in the Church
Council.
During his trial, evidence revealed that on November 18, 2000, the man
and nun had been working on the music for the following day's church
service.
Later that day he contacted her and asked to meet with her about
getting an amplifier for the service.
The woman didn't tell anyone about the incident until a week later
They went their separate ways but he later made contact with her
again, asking her to accompany him to the church hall where he wanted
to test sound levels.
When they arrived there, he pushed the door closed and grabbed her
before pushing her up against a wall, the court heard. Further
evidence was that he then pulled up her habit and raped her.
The woman didn't tell anyone about the incident until a week later,
when the convent's mother superior returned from a trip to Namibia.
But February, who is married, denied that he had raped the nun, saying
that they had been involved in an "intimate extramarital
relationship".
He claimed that, on that day, the nun had told him she wanted to "give
herself" to him completely. He said that the two of them had been busy
in the church when she took him by the hand and led him to the
confession room.
February denied that any penetration had taken place.
Giving judgment, the magistrate said the nun's evidence had been
consistent, while February's version was rejected as it was not
reasonably possible that it was true.
On October 8, 2004, February was convicted of the rape and sentenced
to seven years in prison.
He later brought an application for leave to appeal to the Cape High
Court against his conviction and sentence, but the application was
refused.
February then petitioned the Cape High Court for leave to appeal and
Justice John Foxcroft granted the application on October 24 last year.
On Wednesday he successfully approached the high court for bail
pending the appeal.
