Rwanda: Kigali seizes the International Court of Justice against Paris
and Judge Bruguiere
Seized by the families of French co-operators deceased at the time of
the attack perpetrated against the former Rwandan president Juv=E9nal
Habyarimana, on April 6, 1994, which had been followed by the genocide
of almost 800.000 Tutsis and Hutus of the opposition, the French judge
concluded with the responsibility for the mode for Kigali, requested
the delivery of nine warrants for arrest and guest the general
secretary of the United Nations to seize the International penal court
for Rwanda (TPIR) against the current Rwandan president, Paul Kagam=E9.
Denouncing a political operation, Kigali broke its diplomatic
relations with Paris. Today, Kigali estimates that Paris violates the
international law, the immunity granted to the Heads of State and the
sovereignty of Rwanda.
Since the embassy from Rwanda in the Hague - open Rwandan diplomatic
representation in February, after the closing of that of Paris -, the
Minister for justice, Tharcisse Karugarama, estimated that these
mandates prevent " Rwanda to function like a Sovereign state, because
its official cannot circulate freely to achieve to their duties".
Among the men aimed by Judge Bruguiere , three are embarrassed by
these difficulties, explains the minister: the chief of staff, James
Kabarebe, the Marshal of the Diplomatic Corps, Pink Kabuye, and the
ambassador of Rwanda in India, Charles Kayomba.
" So judges, anywhere in the world, sitting in a foreign capital
(=2E..), can indiscriminatory and irresponsibly deliver bills of
indictment and warrants for arrest against the official ones of high
ranking of other Sovereign states? that would be the prelude to
disaster and chaos on the ground of the international law and could
lead to a violation of international peace, disturb the order and the
safety of the nations" , Kigali wrote. The result of the French
investigation " would create a dangerous precedent in which
irresponsible decisions could draw up nations ones against other" ,
the Rwandan authorities estimates.
The International Court of Justice will be able to seize Rwandan
request only if Paris accepts its competence in this business.
Wednesday, the French ministry of the foreign affairs abstained from
any comment on the initiative of Rwanda. On the same topic, but in
front of another jurisdiction, two Rwandan officers aimed by the
investigation of the French judge also carried felt sorry for to
Brussels.
