Unless a challenge by the extreme pro-abortion and gay rights activists
changes things during the upcoming convention week, we are pleased with the
platform language as it pertains to marriage and abortion issues. Needless
to say there are other issues that will not be acceptable to many
conservatives such as the immigration and education issues and a sticking
point for pro-lifers will be the weakened language regarding stem cell
research. While the stem cell language speaks to the need for ethical
vigilance and the worth of adult stem cell research, Senator Frist's 15
minute impassioned speech to the seated delegates lumping ALL stem cell
research into one mixed message served to prevent amendments by Delegates
Cathy Adams and Linda Daves calling for a ban on the embryonic research that
kills the human embryo. This was unfortunate and signaled the fight ahead to
stop the killing of human embryos by the bio-tech industry and the wealthy
disease organizations. FRC staff will continue to monitor the activity
surrounding this convention as we did in Boston.

Polls Continue to Trend Pro-Life...
In a recent paper, FRC's Jayd Henricks examined polling data giving evidence
that pro-life positions help candidates politically. A new Pace Poll
confirms a growing pro-life trend and even suggests Kerry voters tend to be
significantly more pro-life than the Senator and the Democratic Party.
According to the poll, 44 percent of those surveyed are pro-abortion while
54 percent are pro-life. What is especially noteworthy is that key
Democratic constituencies are significantly more pro-life than the general
public. First-time Latino voters poll 61 percent pro-life to 34 percent
pro-abortion. Among blacks the breakdown is 59 percent pro-life to 42
percent pro-abortion. In the same poll a plurality of Kerry voters, 34
percent, believe "abortion should be legal only in the most extreme cases,
such as to save the life of the mother, incest, or rape." These numbers
suggest an opportunity for pro-life candidates, both Republican and
Democratic, to use the abortion issue to their political benefit. The
abortion issue is not, as many pundits suggest, something pro-life
candidates should avoid. It is, rather, a winning issue that has the
potential to reshape American politics.

....but Court Strikes Down PBA Ban
In an expected ruling a U.S. District Judge in Manhattan said the
partial-birth abortion ban signed into law last year is unconstitutional.
While it seems the particular judge involved in this case was sympathetic to
arguments made in defense of the law, in the end he ruled he was bound by
previous Supreme Court decisions requiring an exception to preserve a
woman's health. As I have noted before, the definition of health here is so
broad that a doctor could use any reason to invoke the health clause,
thereby making the ban no ban at all. Fortunately, there are still
opportunities for the courts to uphold a ban on this barbaric and inhumane
procedure. In the end, the Supreme Court will be faced with a decision to
rule again on the constitutionality of a ban. This time we hope the Court
will rule with judicial prudence and uphold the will of the American people
to ban this gruesome abortion procedure.
