religious functions". Madison clearly states that government powers are
limited to civil functions.
In his "Essays on Monopolies", Madison states the lack of Constitutional
authority for government chaplains and prayers. "Is the appointment of
Chaplains to the two Houses of Congress consistent with the Constitution,
and with the pure principle of religious freedom? In strictness the
answer on both points must be in the negative. The Constitution of the
United States forbids everything like an establishment of a national
religion. The law appointing Chaplains establishes a religious worship
for the national representatives, to be performed by Ministers of
religion, elected by a majority of them, and these are to be paid out of
the national taxes. Does this not involve the principle of a national
establishment?"

as effectively as can be imagined.
So Jefferson, another founder, _also_ "said something at the time."

They are, and have been forever. And the Supreme Court upheld it. But
under the rules, the House and Senate Chaplains are like a military
chaplain, in that they are supposed to act in a non-denominational
manner, and treat all members of that body the same. They get about
$120-130,000 per year, which sounds like a lot, until you realize
that's how much we pay Blackwater about every 15 minutes over in Iraq.
IOW, it's bothersome, but it's not a huge issue...
