State Bar gets Janklow's presentence report

SIOUX FALLS — The judge in Bill Janklow's second- degree manslaughter
case will allow the State Bar's lawyer to see some sealed information.
According to a document filed Monday, Judge Rodney Steele signed an
order that releases a copy of Janklow's presentence investigation
report and a transcript of the sentencing to Beresford lawyer Robert
Frieberg, counsel for the South Dakota Disciplinary Board.
That panel will recommend whether Janklow should still be allowed to
practice law.
On Dec. 9, one day after Janklow was convicted of second-degree
manslaughter and three lesser crimes, Janklow started the automatic
review of his South Dakota license to practice law.
He filed a report formally notifying the South Dakota Supreme Court
that he had been convicted of a felony, and the high court suspended
his license pending a review.
The Supreme Court and the Disciplinary Board of the State Bar must
review the law license of any lawyer convicted of a felony.
After a review and recommendation by the Disciplinary Board, the
Supreme Court decides whether Jank-low will be disciplined further.
The court could disbar Jank-low, suspend his law license for a
specific period or take no disciplinary action.
Tom Barnett, executive director of the State Bar, said the presentence
report will help the volunteer seven-member disciplinary board draw a
conclusion because it contains facts about the case, as well as
details about Janklow's competency, character and fitness to practice
law.
"The presentence investigation contains a wealth of relevant
information," Barnett said.
The presentence report is not a public document.
A Moody County jury on Dec. 8 convicted Janklow of felony
second-degree manslaughter and three misdemeanors for a traffic crash
that killed Randy Scott of Hardwick, Minn. He was sentenced Thursday
to 100 days in jail, fined $5,750 and placed on probation for three
years, during which time he may not drive.
