VIRGINIA - A former Cass County political figure and his wife were
convicted Monday of sexually abusing one of his nieces four years ago.
A Cass County jury convicted John K. Butler, 45, and Lisa Y. Butler, 35,
both of Ashland, of aggravated criminal sexual abuse for an incident
involving John Butler's niece, then 16, in the summer of 2000.
A complaint filed in October 2002 alleged that Lisa Butler fondled and
kissed the girl at the direction of John Butler. The sexual contact
occurred while the girl was baby sitting for John and Lisa Butler's two
daughters at the couple's Ashland home.
Brown County Circuit Judge David Slocum, who presided over the six-day
trial, set sentencing for Aug. 9. Aggravated criminal sexual abuse is
punishable by up to three to seven years in prison. The seven-man,
five-woman jury took about four hours to reach its verdict.
The jury heard testimony earlier from the 16-year-old's sister, then 18,
that she also had been abused by her aunt and uncle after they invited her
to attend Gov. George Ryan's inauguration and related festivities in
January 1999. Neither John nor Lisa Butler were charged in connection with
that incident because the girl was 18 at the time.
"They violated, they betrayed the relationship between themselves and their
niece," special prosecutor Michael Vujovich said. Vujovich, a member of the
state appellate prosecutor's staff, handled the case because Cass County
prosecutors felt they had a conflict. John Butler was elected Cass County
Republican chairman in 2000 and was replaced in 2002, several months before
he was charged.
Defense attorneys Michael Metnick and Richard Kim, who represented Lisa
Butler, and Jay Elmore, John Butler's attorney, argued that both girls lied
about the sexual contact, possibly because of friction between the two
families.
Elmore said in his closing that the 16-year-old lied because she didn't
want to get in trouble. He said she convinced her then-20-year-old
boyfriend to testify he was present at John and Lisa Butler's during a game
of "Truth or Dare" during which John Butler was nude, Lisa was in a
negligee and the girl in her underwear. The boyfriend said John Butler
suggested to him that he engage in sexual relations with both women, but he
declined.
"After the girls (the Butlers' young daughters) went to bed, the devil came
out and started dancing," Vujovich said.
Elmore called the Illinois State Police probe into the allegations "a
half-hearted investigation." State police took no steps to substantiate the
sisters' claims through phone records, day-care attendance of John and Lisa
Butler's daughters or car repair appointments, all of which figured into
witness testimony, he said.
He also said the 16-year-old's statements changed, escalating the level of
abuse she said she suffered.
According to trial testimony, the sexual abuse allegations came out some
weeks after the older sister had a confrontation with John Butler, who
allegedly offered the younger sister beer to take on her drive home from a
family reunion.
The younger girl wouldn't discuss her relationship with John and Lisa
Butler with her parents. Finally, they asked their daughter to write down
anything that might have occurred that made her feel uncomfortable. It was
then the girl described the sexual abuse that occurred after drinking
alcohol.
"This happened several times," she said in the two-page note.
The parents approached the older daughter and asked the same of her, and
that's when she described the alleged motel incident.
When John and Lisa Butler were confronted with the notes, the girls'
parents testified, Lisa Butler said it was a misunderstanding. She
allegedly explained that she "got affectionate" when she had been drinking.
The girls' parents said John Butler told his wife to "shut up."
They said they told John and Lisa they needed help and insisted they get
counseling.
Lisa Butler testified that she and her husband were incredulous at the
allegations and denied everything in the notes. But they agreed to see a
counselor for fear of losing their daughters if authorities were told of
the allegations.
Vujovich said a letter from a counselor to the girls' parents informing
them that the Butlers had attended a session was an indication of the
Butlers' guilt.
Lisa Butler said she and her husband stopped going to counseling on the
advice of an attorney.
Elmore and Metnick also questioned why the 16-year-old hadn't told her own
counselor, whom she had been seeing for a few years, about the incidents.
"They were dirty Butler family secrets, and they were going to be kept
there, in the family," Vujovich responded. "What do you say and who do you
say it to?"
Vujovich addressed defense statements that there was no physical evidence
to link either John or Lisa Butler to a crime.
"You don't commit these offenses in the light of day," he said. "You don't
commit them in the company of friends and family."
