Scoutmaster pleads no contest to molest counts

(12-29) 10:23 PST SAN JOSE -- A longtime Los Altos scoutmaster has
pleaded no contest to nine felony counts of performing sex acts on
children involving three former Boy Scouts who told police he had
molested them over a five-year period beginning in 1987.
Gregory Allen Wagner, 43, had worked with Troop 31 of the Boy Scouts of
America since 1986 but was expelled by the Pacific Skyline Council after
his arrest Aug. 25.
Wagner was arrested after one of his victims, now 29, told police that
Wagner had inappropriately touched him and other boys ranging in age from
12 to 17. Many of the incidents occurred during camping trips.
He pleaded no contest Wednesday to one count of performing a lewd act on
a child under 14 by use of force, six counts of performing a lewd act on
a child under 14 and two counts of performing a lewd act on a child under
14 when the suspect is at least 10 years older than the child.
Sentencing is set for March 24.
Sam Liccardo, the deputy district attorney prosecuting the case for Santa
Clara County, said the maximum sentence would be 27 years and four
months. However, because the acts occurred before 1994, when sentencing
guidelines changed, Wagner would only serve half of that sentence.
Liccardo lauded the man who came forward to police. "It was a very
courageous decision," he said. "He decided he finally needed to speak out
because he was worried about other people being hurt."
James Blackman, Wagner's attorney, could not be reached for comment this
morning.

Well, in this case, you do have to give some credit to the Boy Scout
organization. They do cooperate with the authorities and send these cases
to trial. They don't just shuffle the guilty around from scout troop to
scout troop...

The Boy Scouts of America has asked an Idaho judge to dismiss a lawsuit
brought by two men who were allegedly molested by a Scout leader in
1997.
Ben and Adam steed of Pocatello, sued the Scouts in February, as well as
the Grand Teton Council and various scouting officials.
The Steeds claim the organization and officials were grossly negligent
for hiring Bradley Stowell as a paid program director for a Boy Scout
camp.
According to the claim, Stowell had been identified to several scout
leaders as a pedophile more than six years before his arrest at Camp
Little Lemhi in Swan Valley.
Stowell pleaded guilty to molesting two boys.
Marv Smith is the attorney for the Boy Scouts. He says the Steeds should
be suing Stowell, not scouting leadership.
The Steeds are asking for damages of at least $10,000 dollars.
