Constitutional Amendment Was Approved by Voters Sept. 18

BATON ROUGE, La. -- A state judge Tuesday threw out a Louisiana
constitutional amendment banning gay marriage, less than three weeks after
it was overwhelmingly approved by the voters.
District Judge William Morvant said the amendment was flawed as drawn up by
the Legislature because it had more than one purpose: banning not only gay
marriage but also civil unions.
Michael Johnson, an attorney for supporters of the amendment, said he will
appeal the ruling.
A gay rights group challenged the amendment on several grounds, arguing
among other things that combining the question of gay marriage and the
issue
of civil unions in one ballot question violated state law.
The courts had rejected a similar argument before the Sept. 18 election,
saying it was premature.
Some 78 percent of those voting favored the amendment. The vote was part of
a national backlash against gay marriage, which followed last year's
Massachusetts Supreme Court ruling allowing gay couples to wed.
Proposals to restrict marriage to a man and a woman are on the ballot in
November in 11 states: Arkansas, Georgia, Kentucky, Michigan, Mississippi,
Montana, North Dakota, Ohio, Oklahoma, Oregon and Utah. Missouri voters,
like those in Louisiana, overwhelmingly approved such an amendment earlier
this year.
The Louisiana Legislature pushed through the proposed ban this spring.
Louisiana already had a law against gay marriage, but conservatives warned
that unless it was put in the state constitution, a Louisiana court could
one day follow the Massachusetts example.
Christian conservatives launched a vigorous grassroots campaign to secure
passage.

Yes. But it's a merely technical matter.
The constitution here requires that amendments deal with a single issue.
That is they'd have to separate the banning of gay marriage from the
banning of civil unions. It's not a "win" by any measure as all the
legislature has to do is issue two amendments. Which will then get nearly
80% of the vote.
You know the only reason the vote was only (yeah, I said only) about 80%
for the amendment? Because the parish which the city of New Orleans
occupies was almost (only almost) split on the matter (55% for, 45%
against). Large numbers of parishes were in the 90s. Some as high as 98%.
Anyway...
While people who are on their second or fifth marriage discussed defending
the sanctity of marriage with their current mistress as they waited for
their daiquiri at the drive through (yes, we have drive throughs for mixed
drinks, I am NOT kidding <g>), several million dollars were missing from
public school accounts and nobody's quite sure where they went.
Oh and the superintendent of schools was using school system workers and
resources to have his home boarded up for Ivan. The workers, who
"volunteered" you see, were told to alter their time cards so it would
appear they were off the clock and they were paid cash. And soon as they
finished boarding up his expensive house, they could go board up theirs
and evacuate their families. But not before (after all, they volunteered
because they love the superintendent so much... well, he said that's what
happened). Anyway, I'm sure we'll get to the bottom of this because the
superintendent is investigating himself.
Speaking of which, he's the one the school board tried to fire in secret
by waiting until he went on vacation then convening a sudden meeting to
can him. Then when people noticed and he flew back from vacation, started
whistling and saying "what, us, fire somebody, no we were swapping recipes!"
If we get any more moral around here, we're going to be stealing the
hubcaps off Texas...

You're right. We also have a Constitutional dictate that the marriages
conducted lawfully within one State are binding in all other States.

While people who are on their second or fifth marriage discussed defending
