Inmate gets eight-year sentence for strangling cellmate

A schizophrenic man who pleaded guilty to manslaughter in the 2003
strangling of a fellow inmate at the Ottawa-Carleton Detention Centre
was given an eight-year sentence yesterday.
Because of his mental state, Justice Lynn Ratushny recommended Daniel
Labelle, 31, serve his sentence at the Oak Ridge facility at the
Penetanguishene psychiatric hospital. Mr. Labelle was credited with
three years for pre-trial custody. Where he serves his remaining five
year sentence will be decided by the Ontario Review Board, who will
meet with Mr. Labelle on a yearly basis to assess his mental health and
the risk he poses to the community.
Mr. Labelle admitted last month to killing Robert Hatton, 46, a
convicted pedophile who was jailed for breaching long-term offender
conditions.
An agreed statement of facts read out in court revealed that the two
men shared a cell in a maximum security area for inmates in protective
custody.
When Mr. Labelle told prison staff he couldn't bunk with a pedophile
his request for a transfer to another cell was denied.
