Intelligent design goes on trial in federal court
BY LISA ANDERSON
Chicago Tribune
HARRISBURG, Pa. - (KRT) - The first legal test of intelligent design, a
concept critical of Darwin's theory of evolution, began in federal court
here Monday, setting the stage for a decision that may influence the way
biology is taught in public school classrooms around the country.
Eighty years after the so-called Scopes "Monkey" Trial in Tennessee, which
set proponents of evolutionary theory against adherents of the biblical
account of creation, this trial is being dubbed "Scopes II."
Essentially, it pits Charles Darwin's theory that life evolves through
natural selection and random mutation against intelligent design, which
holds that certain features of life, yet unexplained by evolution, are too
complex to have developed through an undirected process and are best
attributed to an unnamed and unseen intelligent agent.
Such a theory is simply "a 21st Century version of creationism," said Eric
Rothschild, one of the attorneys for the 11 parents of students in the
Dover Area School District, who have brought suit against the district and
its board. Represented by a team of lawyers led by the American Civil
Liberties Union, they maintain that the board is violating the
constitutional separation of church and state by requiring high school
biology students to hear a statement that denigrates the theory of
evolution and introduces intelligent design as an alternative explanation
of the origin of life.
"This case is about free inquiry in education, not a religious agenda,"
said Patrick Gillen, in the defense's opening remarks. Gillen represents
the school district and board, along with two fellow attorneys from the
non-profit Thomas More Law Center in Ann Arbor, Mich., which describes
itself as providing "legal representation without charge to defend and
protect Christians and their religious beliefs in the public square."
While Rothschild in his opening statement said the evidence will show that
intelligent design is religious belief and "not science at all," Gillen
countered that he will demonstrate that "intelligent design theory is
science ... not religion."

.. . . You can't understand a phrase such as "Congress shall make no law
respecting an establishment of religion" by syllogistic reasoning. Words
take their meaning from social as well as textual contexts, which is why "a
page of history is worth a volume of logic." New York Trust Co. v. Eisner,

Prepare to be surprised. Don't forget, this is the state where Arlen
Specter and Rick Santorum have been elected and RE-elected as Senators,
and had Tom Ridge as Governor--after Hugh Carey. They just may decide
that along with ID trumping Evolution, the Sun revolves around the
(flat) Earth. And night vapors are dangerous, which will justify
curfews as a matter of public health.
