IRS raids Kent Hovind's home |
From the article:
------------------------------
Internal Revenue Service agents are investigating a Pensacola man who operates a
creationist theme park and museum off Old Palafox Road and who they say is evading
taxes on more than $1 million in income.
This week, federal IRS agents raided the home and businesses of Kent Hovind, 51, in
the first block of Cummings Road, confiscating all computer and paper records of
financial activity since January 1997.
The creation-science evangelist argues against evolution around the world. He also
sells literature and videos supporting his views and charges admission to his
Pensacola theme park and museum through a number of entities.
But in a sworn statement made to obtain the search warrant served Wednesday, IRS
agent Scott Schneider said none of Hovind's enterprises has a business license in
Escambia County or has tax-exempt status as a nonprofit enterprise.

Another jerk who does not even look!
Which is presumably why I referred you to the IRS website that deals
with the 16th amendment issue and several other attempted dodges.
ANY attack legal or illegal on Hovind is allowed, no?
Hovind, like any US citizen is afforded the protection of the US
constitution and the common law (whatever that's worth these days) but
enjoys no special immunity should he break the law. The IRS were
presumably able to produce reasonable grounds to a judge who issued
the warrant pursuant to their investigation. No doubt if and when the
matters come to trial we'll see whether the investigation was
justified and legal.
He is a menace and he has a point in what he is saying,
What, "gimmie, gimmie, gimmie"?
he

Apparently the US courts disagree. Who Should I believe, I wonder, you

analogous to your views on taxation, which in turn can be summed up in
two words: "Me! Mine!".

I forgot to say that I di look at that site. However It only states their
opinion, none which are supported by actual reference. At one time I went

They didn't supply references? You need references? What happened to "the
evidence is just an unimportant detail"? If anyone who lives in the US
believes RoadRunner, or has any doubts about the legal status of the IRS,
they should consult a good tax lawyer rather than listen to a Net kook. It
could save them a lengthy court trial, embarrassment, and severe costs.
Let's see, you are saying that we should ignore the constitution, the
voluminous case law behind the IRS (did you read US Code Title 26?),
numerous court decisions that would go against you, and accept all this
without you even citing one valid reference?

Maybe before you advise someone to listen to your ravings you should visit
the following web page:
http://www.fraudsandscams.com/sixteenth.htm
The argument that somehow the 16th amendment is null due to a technicality
has been repeatedly rejected by the US Supreme Court. I don't know how they
do it where you are, but the US and UK rely on precedent and case law when
arguing legal situations. These cases, in which decisions of a similar
nature for similar legal situations, mean that any future cases of this type
will be treated pretty much the same way, in order not to waste the court's
valuable time.
Even without the 16th amendment, some form of income tax would be legal, but
it would have to be levied state by state, by state population, rather than
by income on a national basis, so people in states with low personal incomes
would find their citizens paying the highest percentage tax.

Nope. But there are none here who are very sympathetic. He is a liar
and a fraud, and steals money from folks who can't afford it, and does
more serious indirect harm by promoting his religious fantasies.
The IRS itself is ILLEGAL!
It has been upheld by the US Supreme Court, so by definition it is
legal.
I also note that no reputable legal expert think that this is a
problem. There areplenty of economic theorist who believe there
should be no income taxes, but that is different from thinking that it
is actually illegal. Do you honestly think that people like Bill Gates
and the Rockefellers and the Kennedys would not try to get out of
taxes if they could?
And while we all grumble about taxes, I for one have no objection to
the *concept of income taxes. How else would we pay for interstate
highways, the FBI, the military, the national Smithsonian Museum, the
character assassination of leftist commentators, etc.?

Now who is actually the criminal here?
You don't go to jail for not paying taxes. You go to jail for not declaring
taxes.
If you declare and don't pay the government comes and gets what you owe.
That is legal until a law is passed that makes it illegal.
The criminal is the one who breaks the law.
It is law until somebody says it is not a law.
Nobody except a few semi literates hold that it is not law.
I'd bring up the concept of case law but it would strain you.

Internal Revenue Service agents are investigating a Pensacola man who
operates a
creationist theme park and museum off Old Palafox Road and who they say is
evading
taxes on more than $1 million in income.
This week, federal IRS agents raided the home and businesses of Kent
Hovind, 51, in
the first block of Cummings Road, confiscating all computer and paper
records of
financial activity since January 1997.
The creation-science evangelist argues against evolution around the world.
He also
sells literature and videos supporting his views and charges admission to
his
Pensacola theme park and museum through a number of entities.
But in a sworn statement made to obtain the search warrant served
Wednesday, IRS
agent Scott Schneider said none of Hovind's enterprises has a business
license in
Escambia County or has tax-exempt status as a nonprofit enterprise.

Hovind. He didn't pay his taxes. He isn't tax exempt. And Alan
Keyes didn't win the 2000 election. Hence, hovind is a criminial for
not paying his income taxes.

Somehow, I doubt the IRS *really* cares about Hovidian Church Law.
This reminds me of the nonsense espoused by the Common Law Court movement.
It is one's right to believe that one is not subject to the same laws that
the rest of society are. This fantasy is, of course, shattered when the
guys with the guns, badges, and writs actually show-up on one's doorstep,
however.
As Robin Williams said (IIRC and concerning another set of wrong-doing by
"religious" individuals): " Remember folks, it not just a sin-it's a
felony!"
If guilty (which I strongly suspect is the case) I hope he receives proper
due process and punishment. If, in fact, he is not guilty, then I hope he
receives proper due process and acquittal.
In any case, as a Christian, I think that God will be a bit less lenient
concerning matters of Hovidian Church Law than the Federal Judiciary will
be.

wow, how many agents does it take to raid a mobile home? Good thing
hovind didn't just drive away when he got wind of it.
"Since 1997, Hovind has engaged in financial transactions indicating
sources of income and has made deposits to bank accounts well in excess
of $1 million per year during some of these years, which would require
the filing of federal income taxes,' wrote Schneider"
***** this evolution *****, i am going to start duping saps into going to
my goddidit themepark and buy my 'The Evolution Conspiracy' Seminars. I
will detail all Posts pertaining to the EAC Conspiracy there in. Send me
some money and I will tell you how.

they chose me. It will be somebody else next year."
yes, because you will be in jail you S.F.W.G.W.H.D
Hovind's lawyer:
"This is based on misperceptions," Stoll said. "They don't understand how
the church is created and registered, how it operates under church law,

I would be scared to have this guy as a lawyer. The income tax evasion
and non-tax-exempt status is preceisely because the federal governement
doesn't understand these things, because hovind never filed or registered
as such
"Hovind has a May 18 court date to face three misdemeanor charges arising
from his refusal to obtain a permit to construct a metal building on his
property. Hovind said the building meets or exceeds building codes, and
he objects to the permitting process as an undue expense on the church."
Man, what an idiot. I hope gastrich is paying attention, for his own
sake anyway.

charges when they give bad advice, or only their clients?

Its a good thing Noah didn't need a government permit

I was under the impression that Jesus said to Render unto Caesar,
that which is Caesar's. In short, you pay the government taxes.
In not complying with federal and state tax regulations, Hovind not
only broke secular law, he clearly was defying Jesus!
