Um, what?
A testament used to be set by the two men grasping each others testicles.
Yup. In several places in the Old Testament, when person A is making an oath to person
B, A would "put his hand under the thigh" of person B. There is strong evidence from
Canaanite and other Semitic cultures that what actually happened was that person A
would fondle person B's testicles while making the oath. Similar "body oaths" were part
and parcel of most nomadic cultures; with very few artifacts because of the need to
travel as light as possible, contact with some sacred body part -- often the genitals,
sometimes the chest over the heart or the forehead -- by the oath-giver on the body of
the oath-taker was common.
For Bible references to this practice, see:
Genesis 24:2-9
Genesis 47:29-31
For another interesting "thigh" reference, see Genesis 32:25. It seems that when Jacob
was wrestling with a presumed angel, the angel whacked him in the nuts: "When the man
saw that he did not prevail against Jacob, he touched the hollow of his thigh; and
Jacob's thigh was put out of joint as he wrestled with him."

I was going to refute that, but a quick check on Merriam-Webster (http://www.m-w.com)
shows you are correct. Testify, and related words like testate and testament, come from
the Latin word for 'witness', 'testis.' Testicles comes from 'testiculus', or "little
witness." That would be a very interesting bit etymology :-) What are ones "little
witnesses" witnessing, I wonder?

I recall hearing a couple high pitched shrieks in the locker room which
gave testimony to the fact that it hurt like hell if the guy grabbing
the testicles did so with the intention of squeezing the bejesus out of
them. This brings up the possibility that the practice was done to
establish trust.

it it ok for a man touch another mans member?
If the man whose member is being touched has no objections, then it's
OK.
does it make the
difference if it is being in privacy or in front of others?
Yes. Intimate sexual contact, whether between heterosexual or
homosexual partners, belongs in private.
