Posted October 24, 2003 -- Army Spec. Shoshana Johnson, the African
American women who was held prisoner of war in the U.S. invasion of
Iraq, was looking forward to a quiet discharge from the Army in a few
days.
Battle scarred and weary, she has said not a word as her fellow POW
comrade in arms Jessica Lynch cashes in with book and movie deals and
a celebrity status in the media.
But it is the Army that is forcing Johnson to break her peace.
A few days ago, military brass informed her that she would receive a
30 percent disability benefit for her injuries. Lynch, who is White,
was discharged in August and will receive an 80 percent disability
benefit.
The difference amounts to $600 or $700 a month in payments, and that
is causing Johnson and her family to speak out. The are so troubled
by what they see as a "double standard," that they have enlisted Rev.
Jesse Jackson to help make their case to the news media.
Jackson, who plans to plead Johnson's cause with the White House, the
Pentagon and members of Congress, says the payment smacks a double
standard and racism.
"Here's a case of two women, same [unit], same war; everything about
their service commitment and their risk is equal. . . . Yet there's
an enormous contrast between how the military has handled these two
cases," Jackson told The Washington Post.
Johnson's father, Claude Johnson, himself an Army veteran, says that
while neither he nor his family begrudge Lynch her celebrity or
disability payments, he believes that his daughter should get her
due, and it is more than a 30 percent disability benefit.
Johnson, 30, the mother of a 3-year-old daughter, was held captive
for 22 days, when her unit stumbled into an ambush in southern Iraq
last March. Eleven solders were killed, and six, including Lynch and
Johnson, were taken prisoners.

Once again, this is someone bitching about something for which they have no
understanding.
Military disability is not in any way, shape or form related to service
commitment or risk. It is based on level of disability and "line of duty."
Period.
Some examples:
A friend of mine was hit by a car while riding a bicycle. He was not
intoxicated, he had the required safety gear and the driver of the car was
at fault in the accident. Given the fact that he was on active duty at the
time, and not breaking any military regulations, his "line of duty"
requirement was met. Based on his injuries, upon separating from the Air
Force, he was granted 10% disability. (This was for a broken back, 6 months
immobility, six months rehab).
Now, if that same guy had been captured by the enemy, spent 3 years in a
prison camp, escaped and received the same injuries while escaping... he
would get the same 10% disability.
If I were to slip on the ice while walking across the flightline and receive
the same injuries... I would get 10% disability.
If Johnson's disabilities are the same or worse then Lynch's, then she has a
case. She can try to get another medical review. Invoking Jesse Jackson is a
mistake, as he obviously doesn't understand what the hell he's talking about
(again).

It's based on the injuries and the amount of disability from them. The
narrative summary's adjective descriptor is key. If it indicates light
disability that would be the 30%. If the descriptor is a heavy impact
that boosts the percentage.
If she disagrees with the rating then she can indicate so and fight it
in court.

Depends. Something to watch for is when after about 18 months she goes
back for re-evaluation. The percentage of disability can go up, stay
the same, or go down. Below 30% you're out of the military medical
system.
On the plus side is Johnson's disability pay is non-taxable.
She can also go through a V.A. (veteran's administration) evaluation
which often resusts in higher ratings.

is causing Johnson and her family to speak out. The are so troubled
by what they see as a "double standard," that they have enlisted Rev.
Jesse Jackson to help make their case to the news media.
Jackson, who plans to plead Johnson's cause with the White House, the
Pentagon and members of Congress, says the payment smacks a double
standard and racism.
"Here's a case of two women, same [unit], same war; everything about
their service commitment and their risk is equal. . . .
Right. But would you say that someone who losses his legs should get the
same benefit as someone who had no long term damage? It isn't the risk
you are taking that defines the disability payments, but rather what
actually happens to you and the long term effects.
Yet there's
an enormous contrast between how the military has handled these two
cases," Jackson told The Washington Post.
Johnson's father, Claude Johnson, himself an Army veteran, says that
while neither he nor his family begrudge Lynch her celebrity

two ladies is that one is black and the other white, right? Lynch
couldn't possibly be more attractive, have a more compelling story,
etc.? Aren't there plenty of white guys who also survived and aren't

Though it pains me to be seen to even remotely agree with bill bonde... the
child has nothing to do with it. Military disability pay has nothing to do
with how many dependents you may have, nor should it. A single person, with
the same job, has the same personal risk as one who is married with
children.
