JCSM - 100,000 Pages! Now Includes The New Advent Transcrption of the Catholic Encyclopedia?! |
I notice that Jason Gastrich's website is now up to 100,000 pages,
apparently up from 90,000 because of the inclusion of the compete text
of the Catholic Encyclopedia.
It was nice of Mr Knight of New Advent, who owns the copyright to the
online version, to grant Jason permission to include it on the JCSM
website, not least taking into account Jason's view that Roman
Catholics aren't Christians and the sheer effort the transcription of
the original text, over a period of years, took. To hand that over
presumably gratis is simply amazing, and indeed suggests to this
atheist that miracles may well be possible....!
It just goes to show that interfaith dialogue and cooperation is
possible!

Of course. That and "hit count" are all that really matters to
Jason.
I have contacted New Advent. They were unaware of Gastrich's
plagarism. They were also unaware of Gastrich's feelings towards
Catholics. They wanted to know how long he had been plagarizing their
encyclopedia. I told them that one month ago it was not there.

printed in 1913 whose copyright has expired. Maybe Jason thinks that
because the paper version is public domain, the online version is too. I'm
pretty sure it doesn't work like that.

pretty sure it doesn't work like that.
I don't think it has ever been tested in court. That being said, only the
original material specific to the newadvent website would be under copyright.
All the text from the 1913 Encyclopedia is in the Public Domain and being the
person who transcribed it to the Web would not give one any sort of exclusive
right to the text. It would be perfectly acceptable (from a legal standpoint)
to simply write a script that would walk the New Advent Website and gather
all the text from enclopedia and then build my own web page around it.
Now the presentation, the indexing and other features specific to the website
would be under copyright and action could potentially be taken on that.
Though I imagine even that would be hard to do (else the sites that archive
the web could also be shut down).

You cannot copyright the 1913 work.
But you can copyright your own particular version of it,
in this case Mr. Knight may very well copyright his HTML version.
It is copyright, though not the 1913 work itself.
If Jason took it and stripped the 1913 version out, reformatted and removed
the HTML tags Mr. Knight had inserted, he could do that, unless, Mr. Knight
had translated that work or had enlarged it considerably with commentary,
editorial changes additions, foot notes et al. He'd have to remove those
also.
