Judge: District Can't Ban Student Speech |
We can all thank God that some sanity is returning to the judiciary;
no one had the right to silence this little girl

N.Y. School District Violated Student's Rights by Banning Fliers About
Jesus, Judge Says
2007 (AP)- A school district violated a fourth-grader's constitutional
rights to free speech and equal protection by refusing to allow her to
distribute "personal statement" fliers carrying a religious message, a
federal judge has ruled.
The Liverpool Central School District in upstate New York based its
restrictions on "fear or apprehension of disturbance, which is not
enough to overcome the right to freedom of expression," Chief U.S.
District Judge Norman Mordue wrote in a 46-page decision Friday.
"School officials had no right to silence Michaela's personal
Christian testimony," attorney Mat Staver said Monday.

Good for the judge, but the interesting question is whether J. Young
will be equally supportive of a judge allowing a student to distribute
fliers saying any of the following:
1. Let my two daddies marry.
2. Pray to Shiva and the millions of other gods.
3. Religion is the opiate of the masses.
4. Support gay rights.
5. Support Row versus Wade.
6. My god can beat up your god.
Free speach means free speach, not speach that J. Young likes.

Or 7. Fouth graders who distribute religious propaganda are
obviously being raised by mentally ill parents, and should be put in a
foster home for their own good.

Indeed.
(Mind you, I agree that the kid has the right to distribute this *****.
But only if she's willing to accept the free expression of the other
students regarding her beliefs.)

You do realize that that is a good straight line for a lousy and off-
color pun/joke.

Hmm. Something tells me that the writers of the Constitution

When has "sanity" disappeared?
Besides, why do only support free speech when it comes to religious
(read catholic) propaganda while you want to ban Will and Grace for
making fun of your sect?
Do your seriously believe you're making any of us change our minds or
even care with your moronic postings?
Get a life, idiot.

I agree completely. I'm sure you will also extend this principle to the
"Bong Hits 4 Jesus" case, and understand that free speech applies to
non-christians as well.
