Judge rejects 'choose life' car plates
By Paul Davenport
THE ASSOCIATED PRESS
PHOENIX - A federal judge has upheld a state commission's rejection of
a special "choose life" license plate.
U.S. District Judge Paul G. Rosenblatt said the Arizona Life Coalition
failed to show that its constitutional rights of free speech and equal
treatment under the law were violated by the Arizona License Plate
Commission.
In a ruling issued Monday and released Tuesday, Rosenblatt said the
commission acted reasonably while trying "to avoid the appearance (of)
political favoritism in an otherwise nonpublic forum and maintained
state neutrality on the issue, giving neither side a leg up in this
hotly debated public question."
Supporters of the proposed special plate said they will appeal
Rosenblatt's ruling to the 9th U.S. Circuit Court of Appeals.
"Disagreement with the 'Choose Life' message is not a valid reason to
deny a license plate request," said Peter Gentala, a Center for
Arizona Policy attorney who represents the coalition. "The
license-plate program was designed to help service organizations, not
censor their speech."
The coalition submitted its original application in January 2002 and,
after the commission denied the application, sued the state in
September 2003.
Rosenblatt's ruling came in the form of a summary judgment, basically
a pretrial verdict based on both sides' legal arguments.
Neither the U.S. Supreme Court nor the 9th Circuit - the federal
circuit whose territory includes Arizona - has ruled on the
free-speech implications of special license plates.
However, Rosenblatt relied on a 2002 ruling in which the 4th U.S.
Circuit Court of Appeals set a four-part test to decide whether
special plates are speech by government or by private entities. A
finding that the speech was private would allow the government less
leeway.
The 4th Circuit's ruling said South Carolina engaged in viewpoint
discrimination when it refused to allow a special plate to include an
emblem of the Sons of Confederate Veterans.
That court's test includes determining a program's purpose, the degree
of government control over the content of speech, the identity of the
speaker and who bears ultimate responsibility for the content.
Applying the test to the Arizona issue, Rosenblatt said: "Due to the
necessity of vehicle identification by state authorities, speech on
state-approved, state-issued license plates is governmental in nature
and constitutes a nonpublic forum from which access is selective
rather than general."
The Arizona commission was created in 1997 to oversee a program for
nonprofit organizations to seek authorization for special plates. The
requesting organization must meet certain criteria and agree to cover
the costs of developing the plate, which is sold for an additional
fee. The organization gets some of that extra money.
The commission has approved 11 special plates for organizations,
though groups in recent years have sought to bypass the commission and
get authorization from the Legislature. However, recent legislation to
authorize special plates still requires the groups involved to pay
development costs.

Actually not so, elmer fudd. The reason is that there are no license plates
pushing "choose death" thus balancing the slate. It's not worthwhile to make
something no one is stupid enough to buy.

You militant atheists pretty much all work from the same script.
Although viewing yourselves as "free thinkers", you all have a Party Line
you follow rather closely.
It isn't difficult to anticipate your arguments on any
given point. Most intelligent religious individuals almost always can
correctly predict what
you'll say next.Interestingly, militant atheists get much of their beliefs
about "Christianity" from liberal Christians.
They'll pejoratively label all Christians as "Fundies",
then presumptively attack liberal theological concepts
they suppose us "Fundies" subscribe to !
Nearly all militant atheists are followers of the
religion of Scientism. Their priests wear white lab
coats. Their sacramental objects are the microscope,
the telescope, and the test tube. Blasphemy is to
deny the ultimate authority of science.
But the militant atheists -the ones who have devoted
their lives to refuting Christianity- are almost like the
demons ...who believe more firmly in God's existence
than do Christians !
It can unequivocally be stated that militant atheists are some
of the people who most solidly believe in God !
Ain't talking 'practical atheists' here ...those who don't
even think much about atheism. They're the true
atheists.
Professional atheists who've dedicated themselves
to eradicating the Lord do so because they hate Him.
They're the God-haters.
To which they'll invariably reply: 'How can we hate
something we don't believe in ?'.
Exactly ! It's their belief in God which drives them to
relentlessly attack Him.
Run of the mill, everyday 'practical atheists' don't
give God a second thought. They're the ones
I worry about.
Whereas militant atheists are fighting against the
innate knowledge of suppressed in their hearts.
As a militant atheist I can unequivocally state that there is no time in
your life that you
totally disbelieved in God. And -in fact- were driven to
work against the Lord by belief in Him !
It isn't that militant atheists don't believe God exists.
Instead: That they don't want God to exist.

kant, thats a pretty ***** convincing argument uve put forth.
but are all militant atheists (MA to save me typing :p) fighting
others' belief in God? would it make these MAs happy if they convinced
their listeners to drop God and become atheists? maybe, maybe not.
ive been an MA sometimes, and its not so my "opponent" drops God, its
because they something deeply stupid or spiteful. its because they
discriminate or crap all over certain ppl because of their beliefs.
because they lose the point of God and Jesus and Bible and twist it to
their own advantage. because they refute science. because they agree
with the torture of Galileo and co, who tried to add to the world of
knowledge. because God is supposed to be loving and yet the Church can
be so cruel and bloodthirsty. because they justify the holy war in
Iraq. the list goes on forever.
now, if somebody rattled off how homosexuals are sinners, that they are
hell-bound, that they "must see the Light and change their ways!" and
all that nonsense, then quote [1 Corinthians 6:9, NIV], they will cop a
whole lot of militant atheism from me! sadly this wedge issue arose
with a classmate of mine and has certainly soured the friendship. how
tragic. if i had to choose between harassing and persecuting gays or to
denounce the faith in God that my family would have held for centuries,
which to choose? i bet God really doesnt have any issues with gays at
all, but the Church is God's human mouthpiece....
" Professional atheists who've dedicated themselves to eradicating the
Lord do so because they hate Him. They're the God-haters. "
do professional atheists hate God? no. we just really hate His fan
club!
i pick fights with christians when they turn away from the moral and
ethical messages that Jesus gave and turn it into fodder for their
redneck ultraconservatice hatred!
i was born a christian, but denounced my faith over the past few years
as i have witnessed so much disgusting behaviour by the church (in
history and today) and by some of the stronger christians i have
encountered in the news or in person.
im sorry God, but your apparently stronger followers have disgusted me
beyond repair. the Bible was written by HUMANS and yet how many people
have suffered or died because what they said, believed or proved to be
true contradicted with "the Scripture"?!
God and Jesus were good blokes, but CHRISTIANITY SUCKS. a great idea,
but poorly marketed!
LOVE THY NEIGHBOUR. its not that fucking hard!
like they needed those other thousands of pages of nonsense! people
seem to care more that Jesus died on a cross than anything else! listen
to his message and heed it morons! Bush and his mates may attend church
as much as they like but they are some of the worst public Christians i
have ever come across.
poor old God. and Jesus. i guess being all-knowing they expected humans
to bury their message in so many layers of *****.
and for the record: science will always be #1 for me. until God is
proven to be made up of molecules and matter, He was just made up by
Man. that said, Jesus was just a human, and the Virgin Mary? well lets
just say Jesus was Her son, leave the virginity to rest in the muddy
waters of time. if a test tube or a particle accelerator cant prove it,
leave it as "religion". ill just pretend it exists cause its "good for
the soul".
