Judges: Planned Parenthood Can Protect Child Predators |
This ruling is a travesty and hopefully this lawsuit will find merit with
the Ohio Supreme Court.

CINCINNATI -- A state appeals court Friday overturned a judge's ruling that
said Cincinnati Planned Parenthood must give other minors' abortion records
to a family who is suing the clinic over a teenage girl's abortion. The suit
alleges that Planned Parenthood never got parental consent to perform an
abortion on the girl as required by Ohio law. The lawsuit sought records of
other minors' abortion records going back 10 years in an effort show that
the clinic had a pattern of a failing to notify parents, and a Hamilton
County judge last year agreed to the request. Brian Hurley, attorney for the
family, said they will appeal the ruling to the Ohio Supreme Court.

Here is the text of the actual decision written by that court:

On the last page they state:
"The Roes need only prove that Planned Parenthood violated its duty to
the Roes in this case-no more, no less. Whether Planned Parenthood has
violated Ohio law in the past bears no relevance to, and is not
necessary in determining, whether Planned Parenthood violated the law
as to Jane. Likewise, the records are not necessary for either
punitive damages or injunctive relief."
Page 13-14 give a bit more detail as to why the records where not
necessary and state that these records would only be necessary for a
class action case.
Ohio is generally a republican state and elects its justices to office
in non-partisan elections. Law is complicated, that's why we have
lawyers. The article you linked to is over-simplifying this issue by
claiming the case is about abortion and outright lying using it's
inflammatory headline that Planned Parenthood protects child
predators. If you read the details of the case, you see that the
child and her soccer coach deliberately deceived the people working
there. The coach was a predator and he was convicted in criminal
court on seven counts of sexual battery.
The Roes wanted those records so they could sue for punitive damages
under a statute that did not allow for punitive damages. Sounds like
they got their revenge, but now they're after money from an entity
they believe can pay up (rather than suing the coach for the damages).
