A Wallace for today
In 1963, Alabama Gov. George C. Wallace personally blocked the
entrance of the University of Alabama in order to prevent
implementation of federal orders to desegregate the school.
In 2003, Alabama Supreme Court Chief Justice Roy Moore is personally
refusing the order of a federal judge to remove a 5,280 pound monument
of the Ten Commandments he secretly had installed in the Alabama
Justice Building.
The law in the cases of the Wallace and Moore defiances is equally
clear.
And it is rooted in the same principle.
Americans of different races and religions have a right to be treated
equally.
Just as Wallace had a responsibility to allow any qualified student to
enter the university, so Moore has a responsibility to assure that
anyone seeking justice - be they Christian, Jewish, Muslim, Buddhist,
Hindu, agnostic or atheist - knows that no religious faith is favored
by the judiciary.
Like Wallace's appearance in the schoolhouse door, Moore's refusal to
remove the monument is a cheap political stunt.
As a local judge, he used a dispute over his decision to display the
Ten Commandments in a county courtroom as a launching pad for a
campaign for the state's Supreme Court.
And his outrageous self-promotion during the current fight indicates
that his ambitions have yet to be satisfied.
As the federal court-ordered deadline for removing the monument
approached, Moore made frequent appearances on national television
programs in which he frequently mispronounced basic legal terms.
His lack of familiarity with the law was confirmed by a combative
pronouncement that, "The rule of law is not what a court says."
Just as Wallace's stunts encouraged violence and lawlessness on the
part of his most extreme followers, so Moore's actions of recent days
have churned up the yahoo element among his minions.
On Wednesday night, more than a dozen of the folks thinking Alabamans
refers to as "Moore-ons" were arrested.
"This is a culture war," declared Gene Chapman, who walked 700 miles
from Texas to Alabama to support Moore's stand.
"I'd go to jail. Happily."
Fair enough.
Ultimately, however, the point is not to put these sad cases in jail.
Nor is there much point to fining Justice Moore, although it appears
that will be necessary.
(Moore's fanatical followers seem to be perfectly willing to bankrupt
Alabama in order to make their point. Spending other people's money
doesn't seem to bother them at all.)
The real point of this whole discussion is that Alabama has another
top official who is preaching disobedience to the law.
And, just as Alabamans still must live with the dark legacy of
Wallace's illegality 40 years after his stance in the schoolhouse
door, so they now are saddled with Moore.
Had Alabamans rejected Wallace in the 1960s, they would have preserved
a measure of their state's tattered honor.
They failed to do so.
Now, they have a chance to reject Moore and his lawlessness.
If they fail to do so this time, they will doom their sorry state to
another 40 years of backwardness, decline and ridicule.
The rest of the United States should look on the spectacle of Justice
Moore leading that poor state into another fool's mission as a
cautionary tale.
The founders of this country were wise to favor strict separation
between church and state.
They were protecting both church and state.
Jefferson, Madison and their comrades - many of them men of faith,
although not precisely the same faith - recognized that neither
religion nor government would be well served when cynical politicians
like Roy Moore tried to mix the two.

In an interview earlier this week, Moore declared that his actions are more
similar to Martin Luther King Jr than to what George Wallace did. I still
cannot understand the claim that the US Constitution and the laws of
America are rooted in the bible. Hell, I don't think Isreal enforces the
stuff in Leviticus any more. And when was the last time anyone went to jail
for coveting. I don't think there are any laws against adultry any more, at
least they are never enforced. Doesn't the Constitution explicitly exclude
the first commandment? Some people are dumb.

The way Judge Moore insulted the memory of MLK Jr, does show his lack of
intelligence. Or were you talking about the "some people are dumb" remark.

I fail to find the insult myself. The guy speaks the truth. Real truth,

assuming - a girl)

by Lawrence vs. Texas.
Adultery can come up in divorce proceedings, however. AFAIK.

They may not be enforceable, but they still remain in state constitutions
in the same way as religious tests for office remain in several states'
constitutions.
They may have been tested and found unenforceable, but that doesn't mean
others won't have to jump through the same legal hoops again.
In "Torcaso" it was decided religious tests for office were
unconstitutional, but Herb Silverman in S.C. still had to jump through
legal hoops to get his notary public, and it took him longer (as he says)
to get his N.P. than it did to get his PhD in Mathematics.
The religious test for office remains in the S.C. constitution.

Adultery can come up in divorce proceedings, however. AFAIK.

Yeah but as a civil matter like breach of contract rather than being
hauled off to jail...
