Here's the latest phoney baloney threat I've received from KP.
He is such a dunce. I hope that the FBI is reading this, since posting
this message to me is probably illegal for several reasons, not just
to mention his posing as an FBI agent. Not only is the message not
signed, but I am told not to reply to it! And, it contains information
that no agent would give to the general public. And, of course, it was
sent through a remailer!

including the forgeries and threats.
Your posts are interfering with a federal investigaton. CEASE AND

Or don't. They won't accept email complaints. Seriously. I know from
experience. <g>
And why bother them with the lunacy of some fat freak idiot who never
actually *does anything. In all the history of Pangborn, nothing has ever
actually happened to anybody despite the threats and other whining.
Hell, I don't think the man can heave his fat ***** out of the chair in
front of his computer to actually do anything serious...

Ken is a person with mental instability. This is obvious from his multiple
personalities alone. Plus he has a criminal record.
He did file a false complaint with Child Protective Services a few years
ago, claiming that I abused my kids. Of course, I had only to show the CPS
person copies of Ken's threats to do exactly that, for the matter to be
closed.....but he's not above attacking and endangering children.
And, if you've made more than one or two posts speaking out against him,
you can rest assured that your ISP's abuse desk has received a few whines
from him. People have had internet accounts pulled because of the sheer
volume of complaints Ken sends, sometimes in the hundreds and usually from
several of his aliases. For this reason, I post through a remailer thus
making it impossible for Ken to know my ISP.
Keep in mind that former clients or prospective clients have come forward
and stated that Ken offered to terrorize their spouses/ex-spouses into
silence. Exercise caution when dealing with Ken.

Yeah but there's an "or" in there. As in "pretends to be" and "acts as
such" OR "demands any money" etc.
You can go to jail for just the act of pretending to be...

Ms Malkin:

I have observed your posts about Ken Pangborn on usenet. Mr. Pangborn
is NOT the person making the forgeries. The real culprit is a man
from Bolingbrook, Illinois named David Dennis Moore. We are working
with the US Attorneys office on 19 felony counts against Moore
including the forgeries and threats.

Your posts are interfering with a federal investigaton. CEASE AND
DESIST immediately or my office is going to charge you with
obstruction of justice as well as undue HARASSMENT of Mr. Pangborn. I
could easily dispatch a team of agents from our Philadelphia office to
repossess your computer equipment.

Repossess? That assumes the government possessed it at some point in the
first place.

This guy isn't even literate, let alone an FBI agent. And by making this
post, whoever it is has committed a federal felony. Violation of 18 USC
912.

For whatever limitations I may have mentally, Kleino, at least I can look at
one of those forgeries from an anonymous remailer (now Happy Lobster etc) and
then see the one following it from the SAME remailer condemning me for the
forgery using the claimed "INFALLIBLE PGP Signature" that is seconds behind the
forgery and the VERY NEXT message ID in SEQUENCE and figure out that it was
posted by the SAME idiot who posted the FORGERY. Not exactly rocket Science Al,
but WAY WAY WAY WAY over YOUR intellectual abilities!

Not unless your purpose is to try to claim that your attacks
against yourself were made by Moore,Alexander, Young, Newton or any
one of the other people who have exposed your lies Pangborn. Then
seeing the same remailer used for both things would make sense and it
does. You make anonymous posts then condemn the people who expose you
and blame them for the posts to take the focus off your lies, the most
recent being your slip up as "Kaiserdrvr" kaiserdrvr@cs.com. Your
sequencing issue doesn't mean *****. Posts can pop up in any given
order determined by when the bundle is dispatched.

Print it out, with headers. Check to see where your nearest FBI field
office is, and *call* them to say you have evidence that some one is
impersonating a federal LEO. That is a felony. The FBI *never*
reveals details of ongoing investigations. They have the muscle to
open up remailers with a warrant, and can get a tap warrant to see if
Kenny is sending out these forgeries.
Based on what I recall, it's about 8-15 years, and a big fine.

True so far as it goes. On the *other hand, we (the US) have managed to
pressure other countries into cooperating. I know we (the US) got an
anonymous remailer in (if I recall correctly) the Netherlands shut down.
On the *other hand, you don't even need the records and don't have to
bother with the remailer at all. The FBI can issue itself permission
(since the Patriot Act) to slap a sniffer on his outgoing packets. No
remailer cooperation needed. Just catch the packets on their way *to the
remailer...

True so far as it goes. On the *other hand, we (the US) have managed to
pressure other countries into cooperating. I know we (the US) got an
anonymous remailer in (if I recall correctly) the Netherlands shut down.

Not over something as relatively insignificant as this. And there are
many countries (some of the poorer ones) who are setting themselves up
as data havens in order to draw business and revenue and will absolutely
not honor any subpoena or court order from the United States or Europe
when it comes to the internet.
Belize is a big player in this game. Many of the internet gambling and
prostitution servers are located in Belize where such things are legal
and encouraged by the government. State governments trying to prosecute
such things have run into a brick wall when trying to deal with the
issue.

On the *other hand, you don't even need the records and don't have to
bother with the remailer at all. The FBI can issue itself permission
(since the Patriot Act) to slap a sniffer on his outgoing packets. No
remailer cooperation needed. Just catch the packets on their way *to the
remailer...

No, the FBI can't issue itself permission to do anything of the kind.
The FBI has to make an application through the Justice Department and if
DOJ approves, then it must be presented to the court for a warrant. It's
true that the court proceedings are secret and closed to the public and
the media but the FBI possesses *no* unilateral power to issue itself
warrants to collect physical or computer evidence.

Then you've not been paying attention to the "administrative" provisions
of the Patriot Act. The DoJ can grant itself permission to do a great many
things and can bypass even the rubber stamping of that joke of a court...

The FBI *still* has to apply to the DOJ to get such an administrative
subpoena and those are only granted in limited cases. The Bureau can't
just go do it all on its own. And those are merely subpoenas, not
warrants.
An actual warrant would be required to acquire the contents of any
communication sent to or from an ISP. Subpoenas only cover the addresses
involved.
Just like with telephones. If the FBI wants to know who you've called
and who is calling you, they can subpoena that information. If they want
to actually listen to your conversations, they have to get a warrant.

Print it out, with headers. Check to see where your nearest FBI field
office is, and *call* them to say you have evidence that some one is
impersonating a federal LEO. That is a felony. The FBI *never*
reveals details of ongoing investigations. They have the muscle to
open up remailers with a warrant,

If they wanted to they could trace him very easily. He must have
posted thousands of bits of garbage over the years and planted a
few clues here and there. Also, any competent programmer could
write software to analyse text in terms of word and phrase
frequency, repeated misspellings, etc. Historians have been doing
that for years. The FBI could probably search several hundred
million usenet posts in a short time looking for anything he has
posted without using a remailer.
But why should they bother?
There are many far more important criminals than Nazi Boy.
And if he ever was caught, his lawyer would probably plead that
his client was too pathetic to be taken seriously.
Though it would probably do him good if he was forbidden to use a
computer for a year or so. Push him out of his bedroom to explore
the world a bit.

None of which would meet the test for admissibility in court. If a
polygraph isn't scientifically reliable enough to meet the standard,
some computer program that analyzes word frequency sure wouldn't cut it.

You're wrong. Language analysis is admissible in courts, but it is
down by foresenic experts. The USSS has an entire office that does
nothing but build profiles from the anonymous threats sent to the
President. The FBI does the same thing with bank robeery notes,
ransom notes and the like. If you can establish a pattern, you can
present it court. The defence, of course, is free to dispute the
vidence.

Sure we do. We profile all the time but we can't prosecute based on
those profiles. We have to have real evidence a person made a threat,
not just our best educated guess.

Scientific evidence has to meet a basic minimum standard. Profiling
evidence alone doesn't meet it.

"We do"? Anyway, if you were in the USSS, you'd understand something
called "building a case" and "getting a warrant." If I could show a
judge Pangborn's past history of harassment, plus an analysis of
writing styles, that might get me enough to get a warrant pertaining
to intercepting copies of his electronic mail to look for evidence of
impersonation of a federal LEO. Not much work, one agent does a
weekly check of the mail trap.

Find me the place where I said that it would stand alone. If that's
all you have going into a felony trial, the defense will eat you for
lunch. Forensic evidence (all of it) is a piece of the puzzle.
