The burgeoning sexuality of 16 and 17-year-olds - a fruitful subject for
makers of arthouse films including Somersault, The Year My Voice Broke and
Kids - is set to become a no-go zone for Victorian filmmakers.
A bill introduced by the State Government expands the definition of
"objectionable films" that cannot be made in Victoria.
At present there is a ban on films in which teenagers under 16 engage in sex
acts or are depicted in an "indecent sexual manner".
Under the change, the threshold age will be increased to 18.
Film groups say the broad wording will put a stop to tackling late teenage
sexuality as a legitimate subject for filmmakers.
Australian Screen Directors Association executive director Richard Harris
acknowledged that depictions of teenagers involved in sex could be
problematic.
"But it's clearly a crucial part of someone's development, and that stage of
life is really fertile ground for drama, because it's a time when people are
testing and experimenting," Mr Harris said.
"I don't think this is a proportionate response to the issue."
Mr Harris warned that films with plotlines similar to the acclaimed
Somersault
could be stopped by the Government's new legislation.
Somersault, the tale of a 16-year-old girl who turns to fleeting sexual
encounters in her search for affection, won a record 13 Australian Film
Industry awards last year.
It was director Cate Shortland's debut film.
Mr Harris called for the bill to be tightened to exclude films with a
genuine
artistic purpose.
Attorney-General Rob Hulls told Parliament that "promoting the physical,
sexual, emotional and psychological safety of all young people is a priority
for this Government".
Although the Government has no plans to amend the bill, the issue of legal
defences against the ban would be raised at a meeting of censorship
ministers
next month, a spokeswoman for Mr Hulls said.
As it stands, the Classification (Publications, Films and Computer Games)
(Enforcement) (Amendment) Bill would ban the production of any film that
"describes or depicts a person who is, or looks like, a minor under 18 years
of
age engaged in sexual activity or depicted in an indecent sexual manner or
context".
Laws already ban the making of X-rated (non-violent erotica) films as well
as
more hardcore films that would be refused classification if put before the
Commonwealth Office of Film and Literature Classification.
The age of sexual consent in Victoria is 16.

Don't give the wowsers ideas. Censorship laws are becoming dangerous
in Australia. A depiction of person who could look like, but is not
in fact, under 18, and a film that is not banned but would be if it
was reviewed. This is vague and dangerous legal terminology. The
religious reich is very organised and governments are scared of them.
Citizens have no rights in our constitution.

It's not much different in the US, actually, where there have been
prosecutions for virtual child porn (with no actual children involved).
Problem is, they have to sell it to a jury, which is generally tough.
And personally, I think provoking them in to saying they've banned Romeo &
Juliet would be a good thing, since it would show them up as the retards
they are. If that's not the beginning of the end, move to another country.
