The Gorelick Myth
In the National Review, Byron York has an article called “Clinton
Claimed Authority to Order No-Warrant Searches.” In it, he cites
then-Deputy Attorney General Jamie Gorelick’s July 14, 1994 testimony
where she argues “the President has inherent authority to conduct
warrantless physical searches for foreign intelligence purposes.”
(This afternoon, Sen. John Cornyn (R-TX) quoted her testimony on the
Senate floor.)
Here is what York obscures: at the time of Gorelick’s testimony,
physical searches weren’t covered under the Foreign Intelligence
Surveillance Act (FISA). It’s not surprising that, in 1994, Gorelick
argued that physical searches weren’t covered by FISA. They weren’t.
With Clinton’s backing, the law was amended in 1995 to include
physical searches.
York claims that, after the law was amended, “the Clinton
administration did not back down from its contention that the
president had the authority to act when necessary.” That’s false.
Neither Gorelick or the Clinton administration ever argued that
president’s inherent “authority” allowed him to ignore FISA. (We’ve
posted the full text of Gorelick’s testimony here).
The Clinton administration viewed FISA, a criminal statute, as the
law. The Bush administration viewed it as a recommendations they could
ignore. That’s the difference.

How was he successful? He lowered taxes by borrowing money that had to
be paid off later by the children. Reagan was a nice, charismatic,
president. No doubt. But he was a poor President, and one that we
were lucky to survive. Unfortunately, after Democrats came in and
straightened out the deficit created by Reagan, the Republicans
borrowed like crazy again so they could claim they were "tax cutters."
The Republican party is a party of borrow and spend conservatives who
are willing to sell out the children tomorrow so the rich can have tax
breaks today.

went in his place. Bush did what Bush does. He advocated a war (Viet

How was he successful?

He shut down Moammar Gaddafi which was important, reduced nuclear
arms, helped to stimulate the economy and rebuilt the military that
Carter nearly diismantled which cost a fortune.
Like most presidents he's overrated by some and underrated by others.
Sometimes we make global judgements about a president rather than
breaking things down into what they were good at and what they failed
in and that gives us a false picture.
Partisan politics certainly doesn't help.
Politics is always distasteful but it's become brutal and vicious in
the past few years in America.
For instance, Clinton did a good thing when he intervened in the
Balkans but did nothing to stop the slaughter in Rwanda.
White people were being murdered in the Balkans of course and black
people were being killed in Rwanda.
That's what made the difference.
Had the Rwandians been white he would have become involved.
Pretty cruel isn't it?
What I just said is absolute bullsh*t of course.
You know it, I know it and anybody with a shred of common decency
wouldn't make the accusation.
If however it had been a Republican president in the same situation I
suspect the claim would not only have been made by those on the
radical left but would have spread like wildfire as the truth because
the left has been so sucessful at convincing their supporters that
Republicans are racist by nature.
And both those on the left and those on the right have been good at
convincing their supporters that their side is the bearer of the
absolute truth, that the opposition never has a good idea and is in

Yes but saddling future taxpayers with debt isn't unique to Reagan or
Republicans.
Both sides ridicule the other for doing it and both sides are equally
guilty.
And the money doesn't have to be borrowed it just has to be spent from
year to year increasing the following years debt.
They all do use the hell out of Social Security funds and of course
that *is* borrowing and has to be paid back.
There was a surplus in Social Security during the Clinton
adminstration which is one reason he could claim a "surplus" but few
of them, Democrat or Republican could hardly wait to get their hands
on it.
One neat little trick they use to lower the estimate on what the
government owes is to not count the money they borrow from government
funds saying that the government can't really owe itsef.
They're a tricky bunch but it works well for them.

Reagan was a nice, charismatic, president. No doubt. But he was a poor President, and one that we
were lucky to survive.

I'm afraid he sort of lived in a dream world but he wasn't nearly as
incompetant as some claim.
He once said that he and Gorbachev had a long private and personal
conversation with nobody present but the two of them which must have
been really interesting given the fact that Gorbachev doesn't speak
english and Reagan didn't speak Russian.

Unfortunately, after Democrats came in and

I wasn't rich under Reagan and got a hell of a tax break, was finally
able to buy a decent house and every dollar I had was worth far more

It's partisan politics and quite a few myths are involved.
A number of economists will talk about how well Reagan did and explain
why they believe it and another group of economists will do just the
opposite.
We can pick and choose which we like best of course and can count on
getting a lot of help from "the party" in making our decision.

Look, I know that for a lie under oath to be considered perjury the
lie has to be deliberate.
The problem is when Clinton said he didn't recall certain things that
happened on numerous occcasions it takes a very naive person to
believe he was telling the truth.
Lawyers and politicians play the technicalities day in and day out.
Clinton was caught, he knew he was caught and he didn't cop a plea for
grand and noble purposes.

I'm not aware of any statement Bush made at the time advocating the
war.
And somebody else went in Clinton's place as well so that argument is
also a double edged sword.
And really, how do you *know* that Bush is a coward?
I don't see that at all.
He's a marked man yet despite the fact that he knows if someone with a
rifle wants to take him out he can, he still appears in public and has
done so since 911.
He's had to face some difficult choices and heavy criticism from those
on the right as well as the left but he stands his ground.
Those are not the acts of a coward.
Would it be fair to call Clinton a coward for evading the draft?
It would be an easy thing to do but there's no evidence I'm aware of
that shows he did it because he was a coward.
Was Gore a coward for only serving six months behind the lines as a

It's policy that should be challanged or defended not some silliness

Yes but saddling future taxpayers with debt isn't unique to Reagan or
Republicans.

No - but he sure did it well.

Both sides ridicule the other for doing it and both sides are equally
guilty.
And the money doesn't have to be borrowed it just has to be spent from
year to year increasing the following years debt.
They all do use the hell out of Social Security funds and of course
that *is* borrowing and has to be paid back.
There was a surplus in Social Security during the Clinton
adminstration which is one reason he could claim a "surplus" but few
of them, Democrat or Republican could hardly wait to get their hands
on it.
One neat little trick they use to lower the estimate on what the
government owes is to not count the money they borrow from government
funds saying that the government can't really owe itsef.
They're a tricky bunch but it works well for them.

Reagan was a nice, charismatic, president. No doubt. But he was a poor
President, and one that we
were lucky to survive.


I'm afraid he sort of lived in a dream world but he wasn't nearly as
incompetant as some claim.

But his personality did work in many areas.

He once said that he and Gorbachev had a long private and personal
conversation with nobody present but the two of them which must have
been really interesting given the fact that Gorbachev doesn't speak
english and Reagan didn't speak Russian.

During that same conversation, Reagan's handlers were concerned because
he Reagan didn't under the technical aspects of Star Wars - Reagan said
later, "Hell, he (Gorbachev) didn't understand that stuff either."
However, it IS scary that he was in charge of firing nuclear missiles
and was not aware they could not be called back once launched.


Unfortunately, after Democrats came in and
straightened out the deficit created by Reagan, the Republicans
borrowed like crazy again so they could claim they were "tax cutters."
The Republican party is a party of borrow and spend conservatives who
are willing to sell out the children tomorrow so the rich can have tax
breaks today.


I wasn't rich under Reagan and got a hell of a tax break, was finally
able to buy a decent house and every dollar I had was worth far more
than it was under the Democrat Carter.

Carter was hardly at fault for the economy. Also, I find it ironic
that the Republicans hate Carter so much when he was exactly what they
claim they want - a God fearing Christian.

Republicans blame Carter for everything that happened in the economy
during his administration and Democrats blame Reagan for what followed
his.
It's partisan politics and quite a few myths are involved.
A number of economists will talk about how well Reagan did and explain
why they believe it and another group of economists will do just the
opposite.
We can pick and choose which we like best of course and can count on
getting a lot of help from "the party" in making our decision.


Granted, the impeachment was not in our best interest as a country.


Blame Republicans.


Blame the man who committed the crime of perjury.

Perjury requires a (1) lie, (2) under oath, to a (3) material issue.
They had #2. #1 is arguable, and #3 is non-existent. #1 was REALLY
poorly word questions and the attorney screwed that up.

Where would that end?

the know for the opinion that he did violate the Constitution?

Actually, I AM a lawyer. As for whether he violated the United States
Constitution, it seems very clear to me that he did. If I were his
lawyer, the best claim I could come up with is that the directive from
Congress to go to war if need be somehow allowed him to wiretap w/o a
warrant. The problem with that is, it is a ***** argument -
congress never intended it, and even if congress HAD intended it, they
don't have that authority.
There is only one way Bush can escape this. That is if the congress
looks the other way - which they might.

Look, I know that for a lie under oath to be considered perjury the
lie has to be deliberate.

And a material issue.

The problem is when Clinton said he didn't recall certain things that
happened on numerous occcasions it takes a very naive person to
believe he was telling the truth.

Well, notwithstanding the material issue, it is hard to make a case
that a person remembered something he says he didn't. I have even had
people "forget" at a deposition and "remember" at trial.

Lawyers and politicians play the technicalities day in and day out.
Clinton was caught, he knew he was caught and he didn't cop a plea for
grand and noble purposes.

Here is what I really believe. Clinton is smart - really smart. He
couched his comments so they were "technically" not a lie. He is good
at that and known for it. That is why he later admitted to
"misleading" the American public. "Mislead" is the correct word. "I
did not have sex with that woman." Is that true or not? Some would
say yes, others no. No one in the Grand Jury asked him for more
detail. I suspect it was because they were salivating at the thought
that they caught him. That caused them to blow the whole thing.


Would it be ok for a conservative to do it?


If a Conservative did what Clinton did, and they have, in spades, I
would say it wasn't wrong for them, either. Why do you suppose I don't
complain about Newt Gingrich, for example?

He's a damned dishonest, unethical bully.

I know - but he is too obvious. I figure everyone just agrees.

I don't have any use for him despite that public display of a nice and
decent personality.

My problem is that too many are too willing to excuse their guy no
matter what he does.
It isn't healthy for us to do that.
Those pricks on both sides have very few noble standards because we
don't demand it.
We are far bigger fools than they are.
They always know what they are doing when it comes to politics while
we very often only think we do.

I agree. I wish there was a way to get more honest politicians. I
think it is a sign of our society. We are more interested in our
"team" winning. (Democrats or Republicans) We don't care about
standards. Sadly, I doubt it will get better.

evading the draft during Vietnam.

And it was a stupid, childish and unfair thing for the right to be

If one side does it the other is going to do it as well.
The bastards make the rules then whine like a bunch of babies when it

But here is the problem I had with all this Kerry, Gore, Clinton
conduct vs. Bush conduct. Lets use Kerry - he is the best example (for
my purposes.)
Kerry, in the 1960's, stated that he OPPOSED the Vietnam war.  Think
about that.  He opposed it.  He felt we were wrong in our actions in
Vietnam.  And who knows?  Maybe he was right?  But he loved and
respected his country.  He knew his country needed him, and even though
he felt we were wrong in our policy in Vietnam, he volunteered to fight
in Vietnam and fought for his country .  He knew that as an American,
he needed to give to his country and protect it by lying down his
life, if need be, for freedom, even though he, personally, disagreed
with our policy on Vietnam.
Bush, on the other hand, claimed he SUPPORTED the Vietnam war.  Think
about THAT.  He supported a war in which hundreds of Americans died
each month.  He thought that our country needed to invade another
country and that thousands of Americans had to die in the name of
America and freedom.  And who knows?  Maybe he was right?  So what did
HE do?  He got his father to pull some strings so that he could be sent
in front of over five hundred people waiting for a place in the, then
safe, National Guard.  He claimed he supported the war, but when it
came time to be there for his country, he ran from battle.  There is no
doubt about it, someone else went in his place, and that person may
have died. Then, as though that wasn't good enough, he went AWOL.

George W. Bush refused to answer the question about his prior use of
Cocaine. Every other candidate all said the never used cocaine except
George W. Bush. Why refuse to deny he's used cocaine? Probably because
George W. Bush actually did cocaine. If Bush didn't use cocaine he'd
say he didn't use cocaine.


He has talked around the issue in the past
making it clear he has used cocaine.


How does that make it clear?

Bush once said, "I could have passed the [FBI] background check on the
standards applied on the most stringent conditions when my dad was
president of the United States - a 15-year period," This is ambiguous
because background forms ask slightly different questions, depending on
the position. Drug questions can go back one year, seven years or 10
years. Bush Jr. didn't have any formal position in his father's
administration, so which one applies is unclear. And 15-years is not
one of the choices.
He won't deny using cocaine or marijuana, though under persistent
questioning he said that he hadn't used cocaine for 7 years prior to
the 2000 election.

The gossip writer Kitty Kelly wrote another damned book and even some
of the people she claimed said certain things deny they said them.
That's a fairly routine thing for Kelly.
She makes good money doing it.

As I say, I think that when you consider his background and they
comments he has made, it is clear he used cocaine.


And finally, his daddy pulled
strings to keep him from going to Viet Nam, which means someone else
went in his place. Bush did what Bush does. He advocated a war (Viet
Nam) but refused to actually fight himself. He prefers others die
while he remains safe. He is a big talker but a coward and a disgrace
to his country.


I'm not aware of any statement Bush made at the time advocating the
war.

I have seen quotes by him in which he did support the war.

And somebody else went in Clinton's place as well so that argument is
also a double edged sword.

Clinton had long opposed the Vietnam war. As a Rhodes scholar in
England, he helped organize an anti - war protest in November of 1969.
But he has also said that it was his doubts about the morality of the
war and the Selective Service system that led him to abandon the ROTC
idea and to subject himself to a draft lottery. Only the luck of the
draw - a high lottery number - kept him out. One of his friends from
his Oxford days strongly backs Clinton's story.

And really, how do you *know* that Bush is a coward?
I don't see that at all.

He went AWOL. He had his father put the fix in so he wouldn't be
called up.

He's a marked man yet despite the fact that he knows if someone with a
rifle wants to take him out he can, he still appears in public and has
done so since 911.

He is well protected.

He's had to face some difficult choices and heavy criticism from those
on the right as well as the left but he stands his ground.

But is standing your ground, right or wrong, a virtue? I call it pig
headed.

Those are not the acts of a coward.

I absolutely disagree. He has a history of favoring wars where others
die and he is safe. He has no idea what war is like but vacations on a
record basis while others die for no reason.

Would it be fair to call Clinton a coward for evading the draft?

I have yet to see real proof that Clinton ever evaded the draft.

It would be an easy thing to do but there's no evidence I'm aware of
that shows he did it because he was a coward.

I think the whole Vietnam, AWOL thing pretty much proves it.

I don't see how. Ask a non-partisan Vietnam veteran if there were any
"safe" jobs in Vietnam. The Castle Courier, a newspaper of the U.S.
Army Engineering Command, and other publications suggest that Gore
pulled his weight, which in his case meant choppering around to report
features about the good works of the 20th Engineers...
When he was scheduled to leave for R&R in Hawaii, a sergeant called for
volunteers. Gore stepped up and spent a cold night in a foxhole. "Al
did what everybody else did," said Mike O'Hara, the photographer who
shot the Khe Sanh assignment...
Regulations allowed for early release of personnel to teach or attend
school if their services were deemed "not essential to the mission,"
and Gore certainly qualified.

It's policy that should be challanged or defended not some silliness
about something that happened thirty or forty years ago that no longer
has any real meaning.
All that personal trash is nothing but a distraction from real issues.
And politicians love it.

The real issue means little to most people - sadly.
