NeoCon "osprey" Lie of the Day: Clinton Illegaly Wiretapped too (GOP, The Party of Treason) |
Surprise! Another NeoCon lie!
http://thinkprogress.org/2005/12/20/the-gorelick-myth/
The Gorelick Myth
In the National Review, Byron York has an article called “Clinton
Claimed Authority to Order No-Warrant Searches.” In it, he cites
then-Deputy Attorney General Jamie Gorelick’s July 14, 1994 testimony
where she argues “the President has inherent authority to conduct
warrantless physical searches for foreign intelligence purposes.”
(This afternoon, Sen. John Cornyn (R-TX) quoted her testimony on the
Senate floor.)
Here is what York obscures: at the time of Gorelick’s testimony,
physical searches weren’t covered under the Foreign Intelligence
Surveillance Act (FISA). It’s not surprising that, in 1994, Gorelick
argued that physical searches weren’t covered by FISA. They weren’t.
With Clinton’s backing, the law was amended in 1995 to include
physical searches.
York claims that, after the law was amended, “the Clinton
administration did not back down from its contention that the
president had the authority to act when necessary.” That’s false.
Neither Gorelick or the Clinton administration ever argued that
president’s inherent “authority” allowed him to ignore FISA. (We’ve
posted the full text of Gorelick’s testimony here).
The Clinton administration viewed FISA, a criminal statute, as the
law. The Bush administration viewed it as a recommendations they could
ignore. That’s the difference.

Surprise! Another NeoCon lie!
Got a truth for you. Clinton pushed for and signed a bill that allows
corporations to spy on Americans or to hire outsiders to do it - without any
due process.
And then he gave the same right to the Chinese.
And then he declared the earth was flat, right? What next? Clinton is
the father to an alien baby?

Yep. An unfortunate system, But again, entirely legal using courts to
authorize warrants.

Funny how when courts rule the way the RRRwingnuts want technicalities
are good things (Ollie North), when they go against what the RRRwingnuts
want technicalities are bad things (Roe v Wade)

Gorelick's own testimony proves the point that the Clinton
administration position on foreign intel collection was no different
than Bush's:
<quote>
The Department of Justice has consistently taken the position that the
Fourth Amendment requires all searches to be reasonable, including those
conducted for foreign intelligence purposes in the United States or
against U.S. persons abroad. For the reasons I just mentioned, however,
we believe that the warrant clause of the Fourth Amendment is
inapplicable to such searches. We are satisfied, therefore, that
Attorney General approval of foreign intelligence searches pursuant to
the President’s delegation of authority in Executive order 12333 meets
the requirements of the Constitution.
Pre-FISA case law relating to electronic surveillance in the Fifth,
Ninth, Third, and Fourth Circuits have confirmed this view.
Additionally, when the Supreme Court determined that warrant
requirements applied to electronic surveillance for domestic
intelligence purposes in the Keith case, it specifically declined to
apply this holding to foreign powers or their agents.

And it is WARRANTLESS searches that the RIAA and MPAA use to persecute the
P2Pers. No warrants, no warning, no due process. It's how a grandmother gets
sued for downloading music that she wouldn't listen to if they paid her and
another get sued for having a commercial CD in her hard drive playing music

system as well. And they get away with it thanks to Bill Clinton.
