A ruling from a North Carolina judge that allows other religious texts
besides the Bible for swearing in of courtroom witnesses is being
called a further example of the secularization of the procedure.
The American Civil Liberties Union assisted in the case of a Muslim
woman who sued for not being allowed to take her oath on the Koran,
according to Associated Press. Judge Paul Ridgeway ruled that
witnesses and jurors may use the text "most sacred and obligatory upon
their conscience" to make an oath -- in addition to what state law
already allows: laying a hand over the Bible, saying "so help me God"
without the use of a book, or affirming to tell the truth without use
of any religious symbols.
Liberty Counsel's Mat Staver says the affirmation is already a
compromise allowing secularization of a religious oath, and that other
text options are not necessary. "I think the judge is trying to walk a
tightrope here," says the attorney. "On the one hand, he didn't rule
the law unconstitutional as some judges might -- on the other hand,
he's still allowing some flexibility."
The Liberty Counsel founder and chairman believes the main argument
that would be brought forth now is that the requirement to take an
oath on the Bible is a violation of one's "religious conviction or
conscience."
And Staver says taking the Bible away from the process changes the
founding fathers' notion of accountability to God based on the Ten
Commandments of the Bible -- but he admits, "That's the way
secularization has crept into the judicial system today ..... Our
courts have weakened and watered down the religious history and the
significance of oath-taking."

The current constitution of North Carolina does not contain any
religious test for state officials. The original constitution did
so. It forbad Roman Catholics from holding any state office. BTW the
first chief justice of the state's supreme court was William Gaston, a
Roman Catholic who organized and paid for several churches in the
state.
The intents of the founders of the state are expliciately not in the
current constitution. That is the will of the people of North
Carolina. Mr Staver is an *****.
