Minister sentenced to 12 years in fee theft
Joseph Earl Carthron stole her money and that was pretty bad, Tonya
Ward said Friday.
But it was worse that the 35-year-old Little Rock street minister
stole her dream.
Ward wanted a home for her family, and Carthron, through his
company J.C. Affordable Homes LTD., promised he could get it for her
and also help fix her and her husband’s credit problems.
But it didn’t happen, and Carthron stopped returning her phone
calls after she tried to find out why, Ward testified Friday in
Pulaski County Circuit Court.
“If you are looking for a blessing, you found your miracle today”
is how Ward said Carthron greeted her and her husband when they went
to him in search of home financing.
She paid him more than $4,000, she told Circuit Judge John
Langston, for a down payment on a mobile home and for credit
counseling services.
“He told us he could get us this home,” Ward said. “He took us
through the whole process only to end in failure.”
Ward was one of eight of Carthron’s victims to testify at Friday’s
sentencing hearing. Two dozen people in Pulaski County, all with
credit problems, were bilked by his promises of homeownership between
2001 and 2003, Deputy Prosecuting Attorney Catherine Dolan said.
“He targeted poor people,” she said.
For those thefts, Carthron was sentenced Friday to 12 years in
prison, with six of them suspended. He’ll also have to repay his
victims $55,650 as part of his agreement with prosecutors to plead
guilty to theft by deception, a Class B felony. He faced a maximum of
20 years in prison. He will be eligible for parole in about a year.
For $3,500 paid up front, Carthron promised clients he’d either
build them a custom home or help them buy an existing one, Dolan said.
Clients could pay off the $3,500 in regular installments.
If they didn’t pay, Carthron would sue them for the balance, even
though he knew he had no intentions of following through on their
financing, Dolan said.
The prosecutor said Carthron advertised on Christian television
channels and in the Arkansas Democrat-Gazette to attract clients. The
Arkansas attorney general’s office, which is suing Carthron over the
scam, maintains he also hosted seminars on homebuying to attract
clients.
“I understand that people are aggrieved by what has happened,”
Carthron told the judge during his 10 minutes on the witness stand. He
apologized to his victims and asked the judge for the “mercy” of
probation.
He said he always has been an advocate of homeownership by members
of minority groups.
“I do encourage black people to own property, to buy a home, and I
will continue to do that,” said Carthron, who is black.
He testified he had tried to combine the services of a mortgage
broker, developer and credit counselor into one operation. He said his
program collapsed after government regulators made him separate those
business interests and he ran out of sources of financing for his
clients. He said he crossed the country unsuccessfully looking for new
financing sources.
“Never was the intent to deceive anyone,” Carthron told the judge.
“I had no intentions ever of not following through.”
But Dolan pressed Carthron into acknowledging that even if he
started out acting honorably, he didn’t end up doing the right thing
for his clients.
Carthron claimed Friday that he had been a licensed mortgage banker
and broker for 15 years, but the attorney general’s office, in its
lawsuit filed in September 2003, reported he was not licensed with the
Arkansas Department of Finance and Administration.
With no prior felony convictions, Carthron would be a good
candidate for probation, which would allow him to raise the money to
pay back his victims, Carthron’s attorney, Robert Brannon Sloan, told
the judge.
But Langston rejected probation, noting the number of victims, the
amount of money taken and Carthron’s abuse of their trust in him. His
ruling drew applause from Carthron’s victims and their families — an
outburst that the judge quickly shushed.
Prosecutors didn’t make a recommendation on punishment, but Dolan
did withdraw her initial suggestion that Carthron be sentenced to
probation because the victims were evenly split between prison,
restitution and a combination of prison time and restitution.
“I don’t think he ever had any good intentions,” said Jim
De-Priest, senior assistant attorney general in charge of the agency’s
consumer affairs division.
The attorney general’s lawsuit against Carthron, scheduled for
trial in September, claims Carthron violated the state’s Deceptive
Trade Practices Act and the Advance Fee Loan Brokerage Act. The
lawsuit, representing $70,000 and about 40 Arkansas residents, some
not included in the criminal case, claims Carthron’s promises of
credit repair were “deceptive and unconscionable.”
The attorney general’s office has pursued about a half-dozen
similar cases, involving advance fee loans, in the past few years. But
Carthron stands out for the kind of services he was claiming and the
dollar amounts involved, DePriest said.
“Mr. Carthron is pretty unusual,” he said.
Advance fee loan cases usually involve credit card issuers who
promise credit cards in exchange for fees, he said. Charging an
upfront fee for a loan is illegal. Most of those cases involve $100 to
$200 fees, but Carthron is different because he offered mortgages and
the fees he charged were much larger. DePriest said Carthron collected
a substantial amount of money from people who couldn’t afford it.
“They [victims] thought they would never be homeowners,” he said.
“They depended on him and he just strung them along.”
Carthron has other interests in the area, according to public
records. The secretary of state’s office shows Carthron operates
several nonprofit companies in Little Rock and North Little Rock:
Kingly University of World Markets, Spiritual Deliverance Street
Ministry, The Deep South Christian Committee and the United States
Advocates for Guaranteed Home Ownership.
Homeowner hopefuls with bad credit are more vulnerable to
disreputable lenders because they’re afraid to use traditional banking
and mortgage resources, said Hattie McDaniels, a board member of ACORN
(Association of Community Organizations for Reform Now).
She said legitimate assistance through agencies like ACORN is
available, some of it do-it-yourself over the Internet.
“There is help even though their credit is bad,” she said. “We’re
here to help you get on your feet.
ACORN’s home-buyer program helps would-be homeowners with bad
credit repair the damage and qualify for loans through partnering
banks. McDaniels said the process can take as little as eight months
to two years

Professional atheists who've dedicated themselves
to eradicating the Lord do so because they hate Him.
They're the God-haters.
To which they'll invariably reply: 'How can we hate
something we don't believe in ?'.
Exactly ! It's their belief in God which drives them to
relentlessly attack Him.
Run of the mill, everyday 'practical atheists' don't
give God a second thought. They're the ones

Whereas militant atheists are fighting against the
innate knowledge of suppressed in their hearts.
As a militant atheist I can unequivocally state that there is no time in
your life that you
totally disbelieved in God. And -in fact- were driven to
work against the Lord by belief in Him !
It isn't that militant atheists don't believe God exists.
Instead: That they don't want God to exist.

Fake Richard cannot stomach the idea that some people do not believe in
the God that he believes in, so he falsely claims that they do, but are
lying about it. Since Fake Richard has no evidence to support his
pathetic beliefs (which are only a bit like Christian beliefs) he has a
very serious problem dealing with reality.
