Object: OT: Kerry blows his Veep chance
I live in the state of NC. I can say without doubt that Edwards would not
have carried this state in a 2nd Senatorial bid, if he chose to ran. He has
done nothing for the state since going to DC. Edwards made his money and
his name as a trial lawyer. He likes to talk about how his daddy was a mill
worker, and how as a lawyer he stood up for the little guy against the mean
old corporations. His success in gaining unconscionalby large judgements
for these little guys have forced many of these textile corporations to
relocate or go under. He doesn't like to talk about all the little guys who
lost their jobs as a result of excessive tort judgements. I wonder why?

You mean he represented people?
When the vast majoirity of lawsuits are brought by businesses,
you idiots have got to stop pretending that some little old lady
with 3rd degree burns -- who sued McDonalds -- is responsible
for destroying our entire legal system.
It's going to backfire. It's only a matter of time. Maybe a very
brief time...

Kerry did not pick a trust-fund dummy, that's for sure.
Edwards had to major in freakin' TEXTILE SCIENCE at North Carolina
State University to get a job, and ended up being one of the best
lawyers in the country.
He could have become a textile mill supervisor. An UNEMPLOYED textile

None.
Now home many American jobs were lost to foreign
competition after Ford Motor Company decided to
build exploding Pintos back in the 1970s?
Answer: Tens of thousands.
Back in the same time period, how many American jobs
were lost to foreign competition when GM introduced
their guaranteed-to-break-down plastic governors in their

Answer: Tens of thousands.

Well, I suppose if you're willing to sell your soul to Satan so you
don't lose a few precious jobs, you would have a point. Edwards has
adopted a "Rainmaker" profile, so terms like "ambulance chaser" are
best responded with "I'm rubber, you're glue". Trial lawyers are very
capitalistic, indeed, as they are the free market approach to
regulating corporations. Would you rather the government do it?
Well, then, you're a socialist!
Capitalism does not imply Democracy (as China proves with their
superior capitalistic system). Those trying to muddle the two into
some sort of law of politics are pretty much akin to commies
themselves and should be deported (preferably to China) for their
treasonous thoughts.

LOL. Using the government judicial process to extort billions in
unconscionable law suits is "free market approach to regulating
corporations?" Thanks to lawyers like Mr. E, health care insurance costs
are so high that many in states doctors have had to flee to keep their
practices. The textile businesses that his Daddy worked for to put him
through school are now non-existent in this country thanks to the law suits
and ensuing regulations brought to us by those same trial lawyers. Ben and
Kerry cheered every step of the way when big tobacky was their target, but
the Golden Starches and yes, B&J are now on the lawyers' menu. Edwards
didn't send jobs overseas, he sent entire industries overseas. He is the
most prominent of modern-day locusts, destroying entire economies as they
glut on the companies that sustain the rest of us.

I see you don't want to answer the question.

Trial lawyers are very capitalistic, indeed, as they are the free
market approach to regulating corporations. Would you rather the
government do it? Well, then, you're a socialist!

I see you'd rather spew propaganda around than answer my simple
question.
How many workers did Edwards put out of jobs while enriching himself

But giving businessmen prision terms might mean a cost of jobs from
that company - that's too high a price for the conservatives.
Besides, think of all the jobs created by having all those children on
life support machines for the rest of their lives.
Somebody might get rich on that - and it might be Fred. He's just
sure of it.
But don't ask him to pay the taxes on it once he's made it big, that's
unpatriotic - he's too busy sitting around during emergencies waiting
for his staff to take tell him what to do to take care of those kids
to pay for the services he requires from this fine country up to it's
ears in debt.
Such a fine upstanding patriot on the deck of his private boat in a
flight suit waving to the crowd of admirers.

life support machines for the rest of their lives.

More stupid whining, aww, did I kick your ***** so hard that you have to
make up such stupid stories to salve your little feelings?

Somebody might get rich on that - and it might be Fred. He's just
sure of it.

Silly Person, you don't know me. But of course I have already
written that *THAT* kind of product safety issue *is* what the tort
system is all about. It's you and the shyster lobby (who own the
Democrats) who come up with these fairy tales.

But don't ask him to pay the taxes on it once he's made it big, that's
unpatriotic - he's too busy sitting around during emergencies waiting
for his staff to take tell him what to do to take care of those kids
to pay for the services he requires from this fine country up to it's
ears in debt.

More abjectly stupid rhetoric from a poor dumb-dupe of a Democrat.

Such a fine upstanding patriot on the deck of his private boat in a
flight suit waving to the crowd of admirers.

And back to the cowboy posing for the cameras image. How *does* that
line up with the failure to pose for the camera on 9/11 again?
How *do* you keep your doublethink straight? That's why I coudn't be a
leftwinger, I never could keep a straight face while braying the
propaganda slogans.

I hadn't heard of the incident before. When I read it happened to 15

That's an amazingly good description of how trial lawyers do just that with

How many workers did Edwards put out of jobs while enriching himself
with his high-buck tort suits?

Well, it is a difficult question to answer. I cannot begin to compute
that since it's indirect. If a company is able to eat the costs from
it's profit, then probably none. I assume that since you posed the
question, you're able to provide me with some information on the
parameters (amount won, existing profit of company, etc) so I can make
a more educated guess.
The question is also one that warrants speculation. The proper way to
phrase the question was "How many cases in which Edwards tried and won
caused companies to lay off staff"? Edwards did not personally cause
people to lose jobs. It is similar to asking how many jobs I caused
to be lost because, as a software engineer, I automate human
processes. I don't know how many jobs I've caused to be lost, but
perhaps some. May I ask the point to your question? Was there a
better alternative to individuals like him trying the cases, since I
assume you know the details pertaining to the lawsuits in question?

I don't know the specific answers either, though I find quite a bit of
support for the notion that more "tort-friendly" jurisdictions suffer
greater unemployment, in part due to higher unemployment and malpractice
insurance rates.

My point was simply to raise the issue for discussion. I don't have any
particulars. As for a better idea, I don't have one of those either,
though it is clear to me that the tort system in America is out of

Claiming that Edwards has "exploited" plaintiff law seems like another claim
altogether. Why don't we get specific? Has he filed any particular lawsuits
which you believe to be frivolous?

I understand that at least one of his high-profile cases was based on
the *now-discredited* theory that an infant was born with cerebral palsy
that was "caused" by not doing a c-section in time. I believe that was
mentioned in one of the references that I posted.
And of course I'm generalizing from his history to the obvious
likelihood that a Kerry-Edwards administration will be more receptive to
the trial-lawyers lobby in resisting tort reform.

why do you even care?

Let's examine the McDonald's coffee "frivilous lawsuit" in finer
detail. Let us suppose that McDonald's brewed you a cup of coffee
that scalded you because they brew it above the federally regulated
temperature. Let's now suppose that you only wished McDonald's to pay
a approx. $150 bill for medical treatment. McDonald's declines. What
do you do now? Well, you could hope and pray that the government will
help you out a little. Incidentally, the very same people who oppose
trial lawyers oppose big government programs. If these minded
individuals wrote laws supporting tort reform, you're basically
screwed. Lower costs for health care, etc are helpful in some cases,
but in some cases (ala the McDonald's case), the consumer would be
SOL.
My fiancee's car was rammed by a forklift once. The Wal-Mart forklift
operator had no license to drive the vehicle. If a newspaper she
pleaded with to run a story would've declined, she would have no
recourse against a big corporation who is absolutely at fault for
causing damage to her car. Perhaps trial lawyers do need to be
somewhat mitigated in favor other alternatives examined, but the fact
remains that hurting the corporation who has hurt the consumer is
ideal, and trial lawyers are helpful in lieu of more government laws
and regulations. BTW, the good news is that the cost against Wal-Mart
by the news crew's presence at the store cost at least 10-20x the cost
of repairing my fiancee's car. That felt really good, to see people
walking away from a Wal-Mart who would've otherwise spent good money
there.

There is no Federally regulated temperature. Coffee should be served at
100C or 212F. You couldn't serve it any hotter than that if you wanted
to. If it scalds you it's because you're too stupid to realize that
coffee is hot and that you shouldn't put the cup in your stupid lap
while driving. At least the British courts have enough common sense to
deal with those kinds of frivolous suits.
Case dismissed. Court costs assessed to the plaintiff.

Let's now suppose that you only wished McDonald's to pay
a approx. $150 bill for medical treatment. McDonald's declines. What
do you do now?

You hopefully get called an idiot and thrown out of court.

Well, you could hope and pray that the government will

Where was her insurance company? Mine would pay for the damage and then
go after Wal-Mart themselves.
